Fox News Pundits Shit The Bed More Than Usual Over Iran's Detaining Of U.S. Sailors

If you believe the way Fox News covered it, the video that surfaced of Iran’s detention of 10 American sailors was an outrage, the entire incident was a failure of the Obama Administration, and it was totally out of line to thank the Iranians for returning our sailors safely. Join me as I recount the absurd crescendo of commentary from hawkish talking heads.

Watch this whole video if you can, but Andrea Tantaros’s comments are most outlandish, and would be hilarious if they weren’t so sad.

John Kerry thanking the Iranians for essentially humiliating us? ...Again, they were on their knees and they weren’t at their weapons. They should have been at their weapons, not on their knees in submission surrendering. But that’s what the Iranians want, and I just find it to be completely egregious and another failure of the Obama-Jarrett-Rice-Kerry foreign policy of thanking—THANKING!—our enemies.

And then some stuff about Ronald Reagan and how he threatened to nuke Tehran that one time. Great analysi, Andrea.

This was just one of a slew of assumptions, hawkish conclusions and just terrible analysis drawn by pundits not just on Fox but on other networks as well, over the last 24 hours.

All we knew at the time that this segment was recorded, and still for that matter, was that two American Riverine Command Boats were transiting between Kuwait and Bahrain when somehow they ran into mechanical and/or navigational issues and entered into Iranian waters around Farsi Island.

We know that the Iranians came, boarded the craft, and escorted them into port at Farsi Island. They then investigated what happened, gave the sailors a safe place to stay and food, and the next day they not only returned them but also their boats to the Navy unharmed as promised hours earlier.

So far we have no indication that Iran had anything to do with the circumstances that caused this event. All indications are that it was the Navy’s problem, either technically, operationally, or logistically that resulted in these boats drifting into Iranian waters.

With these basic facts in mind, some who are seemingly looking for any reason to spill blood in the Gulf and spin anything into a negative for Obama Administration, turned this into a aggressive and outlandish act by the Iranians.

So let’s break down everywhere they got it wrong.

The Video Of The Sailors With Their Hands Up

This has been maybe the biggest source of manufactured outrage from the whole event. What exactly did they expect the Iranians to do here? Boarding any boat is a risky business, let alone one that is bristling with heavy machine guns, stuffed with small arms, and operated by a country that you have extremely bitter relations with and see as a reasonable foe. Are we supposed to believe that the Iranians should not care about the safety of their own crews executing such a dangerous task?

Not just that, but having a crew put their hands up during a boarding action like this is also for their own safety, so that no mistakes or misinterpretations are made that could lead to a massacre. The U.S. Navy does the same when a threat is perceived, even from lowly fisherman just operating in areas where piracy or smuggling is thought to be occurring. A little precaution can keep everyone safe, and keep an international incident from being the prelude to an outright war.

Tantaros says that the crew should have been at their guns. So if that was the case they would have been firing on Iranian boats, in Iranian waters, with at least one of their boats disabled and unable to maneuver. That would have been a suicide mission.

And for what? The result would have likely been 10 dead American sailors and who knows how many Iranians, and a possible war in the Gulf. All over a mechanical issue with a boat and the Iranians doing what most other countries would have done. I doubt these talking heads would give such insightful and hawkish military advice if it were their kid or loved one on that stranded boat in enemy waters.

If you float into Iranian territory, expect to be surrounded by Iranian gunboats, and the fact that having the crew simply put their hands up and demobilize were the Iranian gun boat crews only demands isn’t enraging—it’s downright professional.

Then again, maybe I missed the memo that said the Iranian Revolutionary Guard has diversified into ship-to-shore white glove concierge service for American gunboats.

The Female Sailor Seen With Her Head Covered

Hey, Iran is a Islamic theocracy, and it is customary for females to wear a hijab. Some in the U.S. may think such a custom is preposterous but the sailor was not in the U.S., she was in Iran. Showing respect for local norms is not exactly a capitulation; in fact it happens every day.

Furthermore, if it helped ease the tensions at the time, is it really such a bad thing? It’s not like they made her convert to Islam at gunpoint. Is the right time for a protest over Islamic traditions after being taken into custody by the Revolutionary Guard?

The Apology

Today, pundits are up in arms that the sailor seemingly in command apologized for crossing into Iranian waters while in custody. Like nearly everything else, we don’t know the full circumstances surrounding this apology, but it seemed like that sailor was doing what is best for his subordinates and answering questions as directly as possible. That’s called leadership. If the Navy wants to throw the book at him for breaking the uniform code of military justice that is their mistake to make.

Put all those who think he should have said nothing in the same position and I doubt they would have acted any different, especially while responsible for their crew’s well-being.

Room, Board And Safe Return

Some have acted like these sailors were locked up in solitary for days. Instead, from what we know, they were largely held together in a safe and comfortable place and given food and water while the situation was being investigated and diplomatically resolved.

The next day the sailors were handed over just as promised, all in good condition, as well as their vessels. How is this a negative outcome? Can the Iranians really be blamed for investigating the circumstances surrounding the intrusion? Hardly, we would have done the same.

Kerry Thanks Iran

Some critics are disgusted that Secretary of State John Kerry thanked Iran for working quick to returning the sailors in good condition. How on earth is thanking another country, especially a long-time foe, for doing the right thing bad foreign policy?

This is being treated is as if Iran abducted these sailors from American waters. They did the exact opposite, and anytime a U.S. service person is promptly returned safely after a sensitive incident with another country a small show of gratitude is not just in good taste, but it is totally justified.

It’s All Obama’s Fault

The Obama Administration has more than its fair share of foreign policy failings. This incident is not one of them.

Without the increased engagement the U.S. has had with Iran, and the broadened channels of communications between power apparatuses in both countries, this incident could have ended much, much worse than it did.

This is not to say that the Iranians can be trusted, or that the nuclear deal was good or bad on its own merits, but the fact that coordination between the U.S. and Iran during a crisis was not a total mess is encouraging and largely a very good thing.

Some will say that this was resolved so smoothly only because the Iranian nuclear deal is about to become fully enacted in the coming days. Sanctions will be lifted and Iranian monies unfrozed, a move that Iran stands to benefit greatly from. And this may be so, but the IRGC is no fan of this deal. In fact they straight up appose it from almost all indications. Yet their behavior, as far as we can tell, seemed professional during this incident.

Time will only tell if U.S.-Iran relations are changing for the long run, but all signs seem to signify that they are at this point, at least in some small but very critical ways.

Even in the highly unlikely chance that the Iranians end up having somehow spoofed these boats’ navigation systems into entering their waters, it still does not justify the hyperbole put forward by many on cable news who had no such info at the time the event occurred.

The art of foreign policy is not a blistering thumb war, it is as methodical game of chess, although it seems like many would love to make you think it is otherwise. The U.S. got its sailors back safe and sound. That should be seen as a win.

Steven Avery's Ex-Fiancée Says He's a Guilty, Abusive "Monster"

On Making a Murderer, Steven Avery’s former fiancée, Jodi Stachowski, was portrayed as his rock (you also may remember her Ski-Doo jacket, her “Warning: Does Not Play Well With Others” T-shirt, and that time she left her purse on the bed). She conducted herself as devoted to Avery up until the point when her probation officer ordered her to move away from the Avery property and issued a “no contact” order (which she got in trouble for violating at least once).

Though Stachowski maintained Avery’s innocence in the docuseries, her tune has now changed. In an interview that aired last night on HLN, whose supposedly raw footage is above, Stachowski called Avery “sick” and “a monster,” deemed their relationship “abusive,” and claimed, “He threatened to kill me, and my family, and a friend of mine.”

“He’d beat me all the time, punch me, throw me against the wall. I tried to leave, he smashed the windshield out of my car so I couldn’t leave him,” she said.

When asked if there were any good times in her two-year relationship with Avery, Stachowski replied, “Maybe two.”

Stachowski said her showing in Making a Murderer was “all an act” because she was intimidated by Avery. “Steven called me and told me that if I didn’t say anything good and nice about him, I’d pay,” she told HLN. She said she took that as him threatening to beat her, in the event that he was released from jail.

The documentary used footage of Stachowski discussing multiple phone conversations the night of Teresa Halbach’s murder to cast doubt on his culpability. Then Stachowski claimed regarding her calls from jail, “The conversation with normal. He didn’t sound rushed or like he was doing anything, and if he was in the middle of doing something, we wouldn’t have talked for 15 minutes.” Here’s that scene:

To HLN, however, Stachowski said that Avery “did sound funny” the night of the murder. “I mean, he didn’t sound rushed or…whatever. But he did sound funny, like he was lying or hiding something,” she said. She said that she repeatedly asked Avery if he killed Halbach and “he always said no,” but she didn’t believe him because, “I know the way he is.”

Stachowski painted Avery as someone who had a chip on his shoulder after spending 18 years in prison for a rape he did not commit. “He told me once, excuse my language, ‘All bitches owe him,’ because of the one that sent him to prison the first time,” she explained. “We all owed him and he could do whatever he wanted.”

Stachowski claimed that she was going to testify against Avery in the Halbach trial, but doesn’t remember if she was interviewed before the trial because she says she tries to “block all that out.” Says she was never bribed by law enforcement and that she was never told by Making a Murderer filmmakers Moira Demos and Laura Ricciardi to make Steven look good, but she doesn’t know if they were aware of his abuse.

On their breakup, which is portrayed in the documentary through Avery’s words as more systematic manipulation, Stachowski gave HLN this account:

We were put on a no-contact after phone calls that were made that my P.O. heard of him talking to his mom something about me, I don’t know, I don’t care. We were put on a no-contact for that, and then one day he called and asked for the camera. Well, the camera’s in police custody. I don’t have it. She had some officers come to the house and arrest me because it was third-party contact. There’s no contact at all. So I went to jail, we talked, and she said it’d be in my best interest if I left. If I stayed, I’d keep getting in trouble. Well, I ain’t getting in trouble forhim. So I moved.

Stachowski also told HLN that she believes Avery’s nephew Brendan Dassey, who was also convicted of Halbach’s murder, is innocent.

But during a 2014 promotional tour for her ill-fated E! talk show The Fabulist (yes), Kristin revealed in an interview her thoughts on one Sienna Miller. Here is the relevant question and answer from that interview, which aired on E!:

E!: Who are your hair idols? Or who gives you hair envy?

Kristin: Mine is really random but it’s Sienna Miller—only because she is always so effortless and she always looks amazing even when she’s pushing her baby in a stroller and it’s up in a little bun. I love that or also love it on a red carpet. I think it’s no fuss and always looks perfect.

Mike Huckabee Loses His Shit When Questioned About Duggar Child Abuse

Mike Huckabee got into a screaming match at a campaign stop in Iowa earlier this week when a woman asked him about his continued support for the Duggars. Mike Huckabee’s response? About five straight minutes of him yelling “You don’t know them!” over and over and over again.

The woman asks Huckabee about his view on child abuse in general (he is against it), before asking:

Then how come you supported them?... You supported them on your website. When the Duggars came out, and their son had molested their child, you more or less said that you felt sorry for the parents. Their parents let it continue for over two years—

Huckabee, audibly irate, interrupts. “You don’t know—ma’am, I’m sorry, but I’m going to stop you... You’re accusing me of supporting child abuse. And I’m going to take you on on that because that hurts my feelings, and is absolutely... Let me tell you something—you have no idea what you’re talking about. You don’t know that family, and I do. You don’t know them. I’ve never supported child abuse—let me finish!”

The bulbous broken record goes on:

You do not know that family. I never supported anything that happened to those daughters. I supported the fact that those daughters were maliciously and savagely abused not just by their brother, but by the news media who maliciously exploited them for their own purpose without regard of what it was doing to those young ladies.

The two go back and forth for a bit before Huckabee, with a fire in his eyes much like the fire that he personally will cause to rain down from the heavens in the coming End of Days, really loses it:

No! You know what? You’ve come in here to confront me, which is fine. The woman, of course, was rightly questioning Huckabee’s moral makeup and not that of the Duggars’ (which, consequently, is also an entirely valid thing to question). But, details.

Chicago Releases Three Videos of Black Teenager's Police Shooting Death

On Thursday, videos of the fatal police shooting of Cedrick Chatman, a black teenager, by a white Chicago police officer in January 2013 were released. Police had said that Chatman pointed a dark object at police as he ran away, the Chicago Tribune reports. The object, it turned out, was a black iPhone box.

In the video above, Chatman, 17, a suspect in a carjacking, is seen running, in the top part of the frame, at about :25. He is being chased by Office Lou Toth. “Officer [Kevin] Fry, on the other hand, did not appear to exhaust any method of capturing Chatman other than shooting him and killing him,” Lorenzo Davis, a former IPRA investigator, told ABC 7 Chicago.

The city had argued for months that releasing the three videos—obtained from a police surveillance camera and cameras outside a convenience store—would incite unrest and make it harder for the Chatman family’s lawsuit to get a fair trial. However, the Tribune reports:

In a surprise court filing Wednesday [...] the city dropped its opposition, citing the ongoing work of Mayor Rahm Emanuel’s Task Force on Police Accountability, which is expected to issue recommendations in March on the city’s long-standing policy of keeping police shooting videos from the public.

Before [U.S. District Judge Robert Gettleman] ruled on the motion Thursday, Jonathan Green, an assistant corporation counsel, told the judge the city is being forced to adapt to “a new world” in which new technologies and the public demand for information on police shootings have taken precedence over the city’s long-standing policy to keep evidence in pending cases under wraps.

“I went to a lot of trouble to decide this issue, and then I get this motion last night saying that this is the Age of Enlightenment with the city and we’re going to be transparent,” Gettleman said Thursday. “I think it’s irresponsible.”

Unlike the dash-cam footage of the Laquan McDonald shooting, these videos are low quality, and the shooting is in the distance. Still, “From our point of view, it’s very clear Mr. Chatman is running as fast as he can,” Brian Coffman, one of the Chatman family’s attorneys, said. “Running away.”

The undercard of tonight’s GOP debate (yes, another one) began at 6 p.m. on Fox News, a time when very few people are at home engaging with their televisions. The debates are so openly pointless that Rand Paul didn’t even bother to show up to this one, choosing instead to do anything other than listen to Rick Santorum’s fossilized god warrior shtick for the hundredth time.

Anyway, Carly Fiorina is there. Fiorina spent a few debates up on the big stage before being relegated back to this shit because her poll numbers have dropped down to where she doesn’t really even have statistically significant support. Fiorina isn’t going to be president but she deeply wants to be recognized as a person of note anyhow, and so she must raise the stakes. Tonight that manifested itself in the form of an especially acidic applause line aimed at a person who wasn’t even in the room:

Very soon Carly Fiorina will be on Twitter launching her zings into the void just like the rest of us.

4 of the 5 Brooklyn Teens Suspected in Brownsville Gang Rape Released After DA Fails to Meet Deadline

The Brooklyn district attorney alerted the court Thursday that he would not make the initial deadline to obtain indictments against four of the five teenagers arrested on suspicion of raping an 18-year-old woman at a Brownsville playground earlier this month. As such, those suspects are to be released without bail.

Three of the defendants, the New York Times reports, had already made bail on Thursday when Ken Thompson, the Brooklyn district attorney, called their families to alert them to the suspects’ release. (In New York, prosecutors have less than a week to obtain a grand-jury indictment after a suspect is arrested on a felony charge. If they cannot, suspects are released, and prosecutors have six months to obtain an indictment.)

Denzel Murray, 14; Ethan Phillip, 15; and Travis Beckford, 17; and Onandi Brown, 17, were to be freed on Thursday. Shaquell Cooper, 15, will remain in jail, as he faces a pending, unrelated assault charge.

“Because we are determined to get to the truth about what happened in that park, we need more time to investigate this complex case and gather more evidence,” Thompson said in a statement. “So, therefore, we have consented to the defendants’ release.”

At first, police said that, on January 7, five men approached the woman and her father at Osborn Playground, threatening them with a gun, before raping her, after forcing him to leave. It was not long, however, before a more convoluted account began to coalesce. Two of the teens said that they’d seen the woman having sex with her father, and that their sex with her was consensual.

“The first story is never the last story,” Police Commissioner Bill Bratton said Thursday. “I think in this case that’s certainly the case or will prove to be the case.” He confirmed that detectives were reviewing cell phone footage of the incident taken by one of the teens.

“It’s 9 to 11 seconds I believe it’s been retrieved from one of the cell phones of the young men being investigated in this matter,” he said. “It is a significant piece of evidence as we try to piece together what happened.” Detectives are still awaiting results of a rape kit, Bratton said.

Further complicating matters, the New York Daily News reports that neither the woman nor her father were able to pick any of the accused teenagers out of a lineup. “The case is getting weaker by the minute,” Onandi Brown’s lawyer, Spencer Leeds, told DNAinfo. He went on:

Leeds claimed the young woman has recanted her accusation and the lawyer cast doubt that the father is biologically related to her. The attorney also suggested that the father’s behavior in the incident seems to disprove that she was raped.

The dad, who had only recently reconnected with the young woman who was sent to a foster home when she was 2, eventually found NYPD officers who returned to the scene with him after the teens had fled, police said.

“Everything that’s been happening so far seems to point in the direction of innocence,” Denzel Murray’s lawyer, Kenneth Montgomery, told the Times. “They have a lot of due diligence to figure out exactly what happened.”

“You wish, if you’re a defendant, that some of those things would’ve been taken care of prior to the arrest, but there’s still time for the district attorney to do the right thing.”

During an otherwise unremarkable response to a question about Second Amendment rights at tonight’s debate, Donald Trump revealed one major flaw in his plan to be President: He has absolutely no idea how the government works.

After your usual gun-nut pandering, Trump had this to say:

And certainly what Barack Obama was doing with the executive order—he doesn’t want to get people together! You know? The old-fashioned way where you get Congress.... You get the Congres, you get the Senate. You get together. You do legislation.

He just writes out an executive order. Not supposed to happen that way.

You get the Congress. You get the Senate. You get together.

You do legislation.

And I’ll be damned if it’s not the classiest, most luxurious legislation you have ever seen. President Trump will do more legislation than you can imagine. At those fancy Congress and Senate legislation happy hours. You know, the ones where they do all the laws.

Assault of Los Angeles Bus Driver Wearing Turban, Called "Terrorist" Not Being Investigated as a Hate Crime

According to the New York-based Sikh Coalition, a Los Angeles bus driver, who was wearing a turban was attacked and called a suicide bomber this past November, ending up in the hospital. Police, the Sikh advocacy group said, should investigate the assault as a hate crime.

On November 6, in Inglewood, Balwinder Jit Singh, 56, who has been a bus driver for 17 years, picked up a passenger on his regular route. From the Los Angeles Times:

The male passenger paid his fare, but then started shouting at Singh, calling him a “terrorist” and “suicide bomber” and accusing him of hijacking the bus, the coalition said.

When Singh dropped the passenger off at Crenshaw and Manchester boulevards, the passenger came back onto the bus and began pummeling him in the face.

Throughout the attack, Singh kept his foot on the brake of the running bus, which had 20 to 25 passengers on board, the coalition said. Once the suspect left, a passenger called the police and Singh was taken to the hospital.

“Psychologically and physically, it was traumatic,” Gurjot Kaur, Singh’s lawyer, said. “It’s very frightening to be attacked in that way.” The name of the assailant has not been released.

According to the Associated Press, the 33-year-old attacker, who has not been named, was arrested on an assault charge the following day. Initially, the incident was not investigated as a hate crime. “We cannot fight hate if law enforcement agencies ignore or fail to recognize hate crimes,” Kaur said.

However, Sheriff’s Captain Karl Schow told the AP that police are now investigating the allegations. “We do investigate hate crimes. We take them very seriously,” he said. “We’re absolutely doubling back and going to add that to the investigation.”

Sensitive New Yorkers Are Very Upset With Ted Cruz For Criticizing New York City

To any reasonable observer, including and especially its own residents, New York City is a swirling vortex of greed, debauchery and sin. Over the past few days, Tea Party hero and Texas Senator Ted Cruz has correctly, if awkwardly and ham-fistedly, noted the hard reality of “New York values” in the course of criticizing his opponent (and perhaps the most famous New Yorker on the planet), Donald Trump. A spokesperson for a Cruz-supporting SuperPAC recently told reporters, “New York is home to many wonderful people and places, but the emphasis is more on money than morality, on self-aggrandizement than humility.” And during Thursday night’s GOP debate, Cruz added, “Everybody understands that the values in New York City are socially liberal and pro-abortion and pro-gay marriage. And focus on money and the media.”

And now, in an odd turn of events, New Yorkers have begun to stage something of a revolt. Congressman Peter King of New York State’s 2nd District told CNN, “Memo to Ted Cruz: New York Values are the heroes of 9/11; the cops who fight terror; and the people you ask for campaign donations. Go back under a rock.” Trump himself responded to Cruz last night by saying, in part, “We rebuilt downtown Manhattan, and everybody in the world watched, and everybody in the world loved New York and loved New Yorkers, and I have to tell you, that was a very insulting statement that Ted made.” Here, also, is the cover of today’s issue of the proudly populist New York Daily News:

(In an accompanying editorial, columnist Mike Lupica not only invokes the city’s response to 9/11 but also argues that Cruz’s comments were “as dumb and tone deaf as Jesse Jackson was calling the city ‘Hymietown.’”)

Cruz is not, of course, the perfect surrogate to deliver an anti-New-York-City message; he recently came under scrutiny for failing to report personal loans totaling over $1 million that were underwritten by Goldman Sachs and Citibank. He’s also received hundreds of thousands of dollars from wealthy New York City bankers, as The Intercept’s Jon Schwarz noted last night. Finally, as the Daily News highlights, Cruz was born in Canada (albeit to an American mother and a Canadian father).

But the candidate speaks an important truth: The people, culture, and government of New York City tend to privilege the pursuit of money over every other possible human endeavor. The raw nerves of New Yorkers, elite or otherwise, only proves his point.

Two Marine Corps Helicopters Missing Off The Coast Of Oahu (Updated)

Details remain very scarce, but two Marine Corps helicopters have reportedly been lost off of Oahu, according to the Marine Corps Times and other sources. A fiery debris field and an empty life raft were found in the area. The Coast Guard is executing a search and rescue effort about two and a half miles off the North Shore of the island.

Reports indicate that the two helicopters are thought to have collided while operating in the dark. Both were based out of MCAS Kaneohe Bay, and each helicopter was carrying six people. Potentially complicating search and rescue efforts are massive waves along Oahu’s North Shore, which are forecast to be the biggest of the season, raising between 30 and 40 feet today.

Although the exact type of helicopters missing remains unknown, MCAS Keneohe Bay hosts rotations of many helicopters representing the full USMC inventory on a temporary basis. It is also home to HMH-464 the “Pegasus” squadron, who operate CH-53E Sea Stallions. Additionally, Marine Light Attack Helicopter Squadron 367 (HMLA-367), also known as “Scarface” Squadron, which flies UH-1Y Venom multi-role utility helicopters, as well as the AH-1Z Viper variant of the venerable Cobra attack helicopter, also calls the base home.

Update: 5:47AM PST- CBS reports that the aircraft involved were two CH-53s.

Update: 6:03AM PST- The Marine Corps Times reports that it has received a statement from the USMC stating:

“The aircraft are from Marine Heavy Helicopter Squadron 463, Marine Aircraft Group 24, 1st Marine Aircraft Wing from Marine Corps Base Hawaii.”

The piece also stated:

“There was a high surf advisory in effect. Rescuers are facing 10-foot waves that were expected to rise. KHON TV in Honolulu reports witnesses in the area heard a loud boom over the water and saw a big flare in the sky. Rescuers have spotted a fire and a debris field, including an empty life raft, but no signs of survivors as of 8:30 a.m. EST.”

Update: 11:29AM PST- The search and rescue effort is still underway, although nobody has been recovered as of yet.

One Person Brain Dead and Another Five Hospitalized in French Drug Trial Gone Horribly Wrong 

According to reports, a private clinical drug trial in France went terribly wrong last night, landing at least six of its subjects in the hospital, with one patient confirmed brain dead.

The details are still scant, but it appears the subjects were healthy volunteers participating in a Phase 1 clinical trial administered by a European drug company at a licensed private institution in the northwestern city of Rennes. The drug they were testing, which has not been identified, was administered orally.

It’s still unclear what went wrong but the hospitalizations are highly unusual for a Phase 1 trial, which generally focuses on a drug’s safety, potential side effects and appropriate dosages.

In the meantime, the Times reports, the trail has been halted and the volunteers recalled. At least three agencies—the French Agency for the Safety of Health Products, the General Inspectorate of Social Affairs and the health branch of the Paris prosecutor’s office—are now reportedly investigating the incident.

France’s minister for social affairs, health and women’s rights, Marisol Touraine, issued a statement Friday expressing her “deep determination to shed light on this tragic accident and establish who was responsible.”

Steven Avery's Defense Attorney "Absolutely" Doubts Avery's Innocence

Steven Avery’s defense attorneys Dean Strang and Jerry Buting appeared on today’s episode of CBS This Morning to discuss their client, Making a Murderer, and the seemingly damning evidence that directors Moira Demos and Laura Ricciardi didn’t include in the show. When Gayle King asked if Strang and Buting were convinced of Avery’s innocence, Strang replied, “I’m not convinced of his guilt,” implying what many viewers have taken away from the show: The prosecution did not prove its case beyond a reasonable doubt.

However, there’s a difference between not receiving a fair trial/conviction and not having murdered the person you’ve been accused of murdering. Anthony Mason followed up with, “So you’re saying there’s some doubt in your mind?” To that, Strang replied, “Sure. Absolutely. And if it was OK to convict people on maybes, I wouldn’t be worried about this. But it’s not.”

The CBS This Morning team also grilled Strang and Buting about what was left out of the series. Regarding evidence of Avery’s DNA under the hood of Teresa Halbach’s car, Strang dodged the question:

The movie gives a very lavish three-hours plus to one trial. The trial went over 200 hours. And I guess if the prosecutor and police are really secure in the convictions they obtained, I’ve wondered why they sound so insecure about a movie that couldn’t necessarily run 200 hours.

The answer here is clearly that Avery’s situation wasn’t quite as cut-and-dry as Demos and Ricciardi’s editing suggests (and also, hello, Murderer is a robust 10 hours, which is a weird thing not to realize if you’ve watched the show, much less lived through it). I have little respect for the way the prosecution and police handled Avery, but this is a completely valid point that needed to be made lest the people who gets their news from Netflix be misled.

Buting later added:

The prosecutor has said that sweat DNA—quote-unquote sweat DNA—was found on the hood, and there’s no such thing as sweat DNA or perspiration DNA. It’s just DNA. Where it comes from, they can’t tell.

Regarding Avery’s three calls to Halbach’s cell phone on the day of her murder, which also went unmentioned in the series, Buting said:

The state is now trying to make that a lot of these pieces that weren’t in the movie more sinister than they really were. It’s nonsense to say that large parts of the state’s case were left out. With regard to this, for instance, also left out was the fact that he called and made an appointment to the office. If he had her cell phone number and was trying to lure her, why would you call the office and create a paper trail? You would just call her directly and no one would ever know that she had come there. Instead, he goes through the office.

Do you still eat at Chipotle? Even after various outbreaks of E. Coli, salmonella, and norovirus swept across its North American locations? If your answer is yes, you must be a very dedicated Chipotle consumer. Which is why you may want to plan ahead for February 8, when every Chipotle restaurant will close for several hours so that its executives can address food safety concerns with staff. A spokesperson for the Denver-cased fast casual chain discussed the plan with Oregonian reporter Lynn Terry:

Chris Arnold, the company’s spokesman, said the meeting would happen Feb. 8 and involve all staff. A range of issues will be covered. “We want to thank our teams for all of their hard work, to discuss some of the changes we are making to enhance food safety, to talk about the restaurants role in all of that and to answer questions from employees,” he said in an email.

Since August, hundreds of people in at least eight states—California, Kansas, Massachusetts, Minnesota, North Dakota, Oklahoma, Oregon and Washington State—have been diagnosed with food poisoning after eating Chipotle fare, so the company will have no shortage of discussion topics.

Walmart Starts Its Slide Out of Retail Dominance 

Walmart announced today that it is closing 269 stores, including 154 in the U.S. This is a very bad sign for Walmart. But is it a bad sign for you?

Well, that depends who you are. In the short term, this is likely a very bad sign for you if you are: a Walmart employee, a Walmart investor, or an unemployed person who had been hoping to get a job at the local Walmart, that is now closing. In the long term, the existence of fewer Walmarts is a good thing for: small businesses everywhere and their employees, most other non-Walmart retailers, and humanity’s soul in general. Since life is lived in the short term, though, it’s worth thinking about what’s happening right now.

Walmart has been struggling with weak financial performance for years now. The company had to raise wages and invest in sprucing up its stores and its website, because it knew that its stores were poorly managed and its sales were suffering. Once upon a time, Walmart appeared to be an unstoppable retail juggernaut that would inevitably destroy its competition with huge scale and rock bottom pricing. Then Amazon came along. Now, Walmart finds itself a laggard in online retailing, which is growing fast even as traditional retail sales stay flat. Walmart is a $200 billion company, but Amazon is worth nearly $270 billion, which shows that everyone believes Amazon’s future is much brighter, even though it doesn’t sell as much crap as Walmart at the moment.

All that adds up to today’s announced store closings. Walmart has more than 11,000 stores, meaning that this is a small move in terms of absolute numbers. But it is something else very important: a concrete move backwards from retail dominance. If you hate Walmart for all the right reasons, you can take this as a ray of hope. The world will not be dominated by Walmart after all. Unfortunately, it is going to be dominated by Amazon, instead, which is, in its own way, nearly as bad.

Fuck Walmart, and fuck Amazon. The most important thing to focus on in this retail battle is what it will mean for the millions of retail workers. The entire retail sector, with some exceptions like Costco, remains committed to low wages, poor working conditions, and hostility towards organized labor. The question now is whether the next era of retailing will be just as bad as the last one. If the workers want to secure an improved position, they better start digging in. The weaker Walmart gets now, the more pressure unions need to apply. They might not get a second chance.
