Twelve years ago to the day, on January 19, 2004, former governor of Vermont Howard Dean stuck a microphone in his mouth and let loose a war cry the likes of which no single human being should have ever been able to create. And yet—Howard Dean screamed. Oh, how Howard Dean screamed.

Yes, Howard Dean screamed a scream so shrill and disquieting that it was destined live on forever in our hearts and on our computer screens. It introduced many of us to the idea that, perhaps, there is a darkness in this world after all. And that’s alright. Because should that darkness ever overwhelm you, be like Howard Dean—and scream.

So happy birthday to the scream that will forever be the defining moment of Howard Dean’s presidential dreams. We’ll never forget you, no matter how hard we try.

South Carolina Republican Who Defended Confederate Flag Proposes Mandatory Criminal Background Checks for Journalists

You may remember State Rep. Mike Pitts of South Carolina from his defeated efforts to keep the Confederate flag flying at the South Carolina State House last year. The intense media scrutiny of those efforts seem to have inspired a fairly cowardly response: According to the text of a bill he verbally introduced at the State House in Columbia today, Pitts wants to establish a government-run “responsible journalism registry” to screen, approve, and credential reporters and journalists in the Palmetto State—or else. The text of the bill’s summary reads (bolding ours):

A bill to amend the code of laws of South Carolina, 1976, by adding chapter 85 to title 40 to enact the “South Carolina Responsible Journalism Registry Law” so as to establish requirements for persons before working as a journalist for a media outlet and for media outlets before hiring a journalist; to require the establishment and operation of a responsible journalism registry by the South Carolina Secretary of State’s office; to authorize registry fees; to establish fines and criminal penalties for violation of the chapter; and for other purposes.

The actual text of the bill, which was published on Tuesday evening, goes on to propose mandatory criminal background checks for working journalists, and details the sorts of infractions that would cause a journalist’s license to practice in South Carolina to be revoked:

(A) A person is not competent to be a journalist if:

(1) within the three years before submitting an application for registration, the person has been determined by a court of law to have committed:

(a) libel, slander, or invasion of privacy; or

(b) a felony if the underlying offense was committed to collect, write, or distribute news or other current information for a media outlet; or

(2) as a journalist, the person has demonstrated a reckless disregard of the basic codes and canons of professional journalism associations, including a disregard of truth, accuracy, objectivity, impartiality, fairness, and public accountability, as applicable to the acquisition of newsworthy information and its subsequent dissemination to the public.

And here are Pitts’ proposed financial and criminal penalties:

(A) A person who works as a journalist without registering pursuant to Section 40-85-30(B):

(1) for a first offense, must be fined not more than twenty-five dollars;

(2) for a second offense, is guilty of a misdemeanor and must be fined not more than one hundred dollars or imprisoned not more than fifteen days, or both; and

(3) for a third or subsequent offense, is guilty of a misdemeanor and must be fined not more than five hundred dollars or imprisoned not more than thirty days, or both.

The proposed legislation is almost certainly unconstitutional. Any government plan to levy “fines and criminal penalties” against reporters or journalists whose work does not meet the government’s standard of “responsible journalism” would almost certainly be overturned on First Amendment grounds. The Supreme Court has repeatedly invalidated government attempts to limit and/or sanction speech, under the principle that “prior restraint” on any form of expression can only be sought after every other legal remedy has been exhausted. In a unanimous decision published in 1976, the Court argued that “prior restraints on speech and publication are the most serious and the least tolerable infringement on First Amendment rights.”

Pitts’ proposed legislation is doubly alarming considering that, in other circumstances, he has invoked the U.S. Constitution to defend other proposals. In 2010, for example, he attempted to revert South Carolina to the gold standard, based upon his interpretation of the Constitution’s commerce clause. He has also tried to expand access to firearms on Second Amendment grounds. After introducing a bill that would let state residents obtain a hidden-carry permit without taking a gun safety course, he told one reporter, “My proposal would free a law-abiding South Carolinian from the requirement of having to take a course to exercise his Second Amendment rights to carry a concealed weapon on his person.”

Pitts did not respond to repeated requests for comment sent on Tuesday afternoon. We’ll update this post if we hear back.

ISIS Magazine Confirms Death of "Jihadi John"

The latest issue of Dabiq, the Town & Country of the bloodthirsty would-be caliphate, just arrived. Included, along with the usual rote propagandizing and tasteful page layouts, is an obituary for the masked militant known as Jihadi John, whose video executions helped make ISIS a household name in terror.

The death of Muhammad Jassim Abdulkarim Olayan al-Dhafiri was first reported by the U.S. government in November of 2015, after the Pentagon said he’d been successfully vaporized in a drone strike. But the spread in Dabiq provides the first official confirmation from the side of ISIS, along with what might be the first photo of the militant’s unmasked face after entering the Islamic State, says Rukmini Callimachi of the New York Times.

From the article:

On Thursday, the 29th of Muharram, 1437, Abū Muhārib finally achieved shahādah for the cause of Allah, which he had sought for so long, as the car he was in was targeted in a strike by an unmanned drone in the city of ar-Raqqah, destroying the car and killing him instantly. May Allah accept our brother among the shuhadā’, envelop him with His mercy, and enter him into the highest levels of al-Firdaws.

The piece also notes his fondness for orphans, though his streak of decapitations is omitted.

Track Palin Was Arrested Last Night for Domestic Violence

Today is a big day for Sarah Palin. She is in Iowa to endorse Donald Trump, which will shore up Trump’s standing with Real Americans and once again give the Palin family a moment in the national spotlight. But things back home aren’t as rosy: Last night, Palin’s son, Track, was charged in Wasilla on domestic violence and weapons charges.

As first reported by Gawker, online court records show that Track Palin, 26, was charged yesterday with assault in the fourth degree (domestic violence), interfering with a report of domestic violence, and possession of a weapon while intoxicated. In a press release, Wasilla Police say they responded to a disturbance at around 10 p.m. last night, and that “an investigation revealed Track Palin had committed a domestic violence assault on a female, interfered with her ability to report a crime of domestic violence, and possessed a firearm while intoxicated.” All three charges are misdemeanors.

Track Palin Was Arrested Last Night for Domestic Violence

Palin was scheduled to be arraigned at 1 p.m. locally (5 p.m. Eastern). Wasilla police declined to release the affidavit regarding the incident, citing an open investigation, but if we receive that report, we will update this post.

Track Palin was first introduced to the public as the most politically convenient of Sarah Palin’s children. In her famous speech at the 2008 Republican National Convention, Palin noted that Track, then 19, would be shipping out to serve in Iraq later that month—on September 11. Like most of the Palins, the ensuing years have been a bit rocky: Tabloids have alleged that Track Palin abused drugs. He married and divorced in less than two years. And he was involved, along with his father and sister Bristol, in a bizarre brawl that led to an embarrassing drunken police interview full of colorful, homophobic language.

On 01/18/2016 at approximately 2204 hours, Wasilla Police responded to a residence for a disturbance. An investigation revealed Track Palin had committed a domestic violence assault on a female, interfered with her ability to report a crime of domestic violence, and possessed a firearm while intoxicated. Palin was arrested and charges of assault in the fourth degree (domestic violence), interfering with a domestic violence report, and misconduct involving weapons in the fourth degree were forwarded to the District Attorney’s Office. Palin was held without bail until arraignment.

Ad Age has secured a heart-rending personal interview with Marcos De Quinto, the Coca-Cola CMO who is overseeing this difficult and transformative time in the history of Coca-Cola Sloganeering. Keep a box of Kleenex-brand tissues nearby as you read this account of De Quinto delving deep into the emotional rationale for the new approach to marketing this particular variety of brown sugar water:

In the interview, Mr. de Quinto explained the one-brand approach visually. He used cans of Coke, Diet Coke and Coke Zero, as well as one of the brand’s mascots, a small stuffed polar bear, to represent the Coke consumer. He placed the bear next to a can of Coke and then put cans of Diet Coke and Coke Zero several feet away.

Loyal consumers, he said, “always have loved the brand Coca-Cola.” But “there are moments when this consumer wants to reduce their sugar intake.” In those cases, Coke was forcing people to buy into a completely separate identify, he explained, referring to the distant Diet Coke and Coke Zero cans.

Bravo, sir. I feel like I am there.

Bravo.

Elsewhere the story notes that Coca-Cola will also have “one TV ad that includes a cover of the Queen and David Bowie song ‘Under Pressure’ that showcases Coke as a way to release everyday tensions faced by teens.” Bravo to that as well, for helping our young people.

Marcos De Quinto is paid a $750,000 base salary per year along with an incentive payment of even more than that and a $300,000 expatriate allowance and a $2.5 million stock grant and I hasten to say that he has earned every penny of it in one bold stroke—of feeling.

How the U.S. Spy Satellite Program Chose This Hilariously Scary Earth-Eating Octopus as Its Logo

Perhaps you remember a time, two years ago, when the U.S. National Reconnaissance Office released its new mission logo, an enormous tentacled monster covering the earth with its sucker-lined legs. Perhaps it reminded you of a comic-book villain from your youth. Perhaps you were only vaguely familiar of the NRO before then, and have since come to think of them only as “the scary octopus guys.” Now, thanks to a Freedom of Information Act request by security researcher Runa Sandvik, highlighted at MuckRock today, we know a bit more about how the scary octopus logo came to be.

In response to Sandvik’s request for documents relating to the preparation of the logo, the NRO sent 15 heavily redacted pages of paperwork dating to 2012, months before NRO launched the satellite bearing the octopus. According to the documents, on some level the logo is an inside joke about a piece of equipment called an “octopus harness.” But mostly, the men and women at the agency chose the image because it looked badass, and you can’t really disagree with them there. One slide from a presentation reads:

The NROL-39 Octopus symbolizes the resourcefulness, adaptability, and perseverance of this mission. The image of the Octopus reaching around the world is representative of this mission and the warfighters it supports, who serve valiantly all over the globe protecting our nation. Like the Octopus, our mission, our warfighters, and our nation will always remain versatile and find a way to adapt to and overcome any threat we face.

Some other interesting details: the text and symbol had to be approved “to ensure neither contains any hidden classified meanings,” and the tentacles were “randomly placed,” perhaps to avoid the appearance of bias.

In 2013, the American public was at the height of its post-Snowden wokeness about surveillance overreach, and the Octopus was rightfully criticized as a tone-deaf way to represent the U.S. intelligence community. As MuckRock notes, there is only one indication in the documents that anyone saw the backlash coming: a handwritten note, in blue pen, on the report’s front page. “A little sinister!!” it reads.

Three hundred and sixty days ago, reality TV personality Kristin Cavallari commenced—I assume—furious work on her debut book Balancing on Heels. Since then, she has changed the title to Balancing in Heels; today, for the first time ever, she provided a clear picture of what will be included in the book. This:

Seven chapters. Thirty pages of recipes. An “index.” It all adds up to one book by Kristin Cavallari. Though the chapter titles are printed in a whimsical font, the chapters themselves appear to be neatly ordered according to the timing of events in Kristin’s life—“Mommy, Mommy” comes before “All Wifed Up,” for example. One of the chapter titles includes a reference to the fact that the author is considered, in some circles, to be a bitch.

As Kristin wrote in the caption of her Instagram, “It’s becoming real! Ahh!!!!”

Jeb Bush Just Called President Obama’s Daughter “Malala”

GOP candidates definitely know that “Malala” is the name of a prominent person that exists. This much we know. GOP candidates do not, however, seem to have any idea who Malala Yousafzai is—or in Jeb Bush’s case, that she is not, in fact, Barack Obama’s daughter.

Speaking at the Council of Foreign Relations today about the consequences of our cultural divide with China, Jeb had this tale to tell. From Politico:

And every meeting I had in Beijing started out for the first 10 minutes started out lambasting me about why it was, as an American, why it was that we insulted China. And I’m thinking, you know what, it could be that Mrs. Obama was worried about the science project of Malala.


In all fairness, there is perhaps a chance that Mrs. Obama was, in fact, worried about some sort of science project by Malala. Though considering that Malala was still chronicling her life in Pakistan under Taliban rule at the time, this seems unlikely.

What’s more likely, however, is that Mrs. Obama was worried about her daughter’s, Malia’s, science project. Jeb. Jeb. Buddy. We’ve been though this before.

If This Terrible Primary Season Goes On Like This, People Might Actually Have to Vote

This morning’s New York Times had two front-page stories about politics that were really one story. One was about the fact that Republicans who identify as evangelical Christians are rallying behind the aggressively impious figure of Donald Trump. The other was about how Hillary Clinton’s campaign is desperately trying to get ready for a prolonged state-by-state nominating contest against Bernie Sanders.

Each story had its own near-overt punchline. The first one captured the truth that American political Christians are not interested at all in the teachings of Jesus Christ, or even in generalized moral goodness, as long as they have someone to amplify the tribal hatreds that truly inspire them. The other described how Clinton, as in 2008, appears to have assembled an expensive and highly professional campaign staff that is flummoxed by the work of campaigning.

But in the background of both stories is a much less funny theme: the difference between what we say our political process is and what the process really is. The Clinton campaign is scrambling to deal with the unforeseen possibility that the nomination for the office of President of the United States might be determined by a series of contests in which various states’ voters cast votes as to which candidate they prefer, rather than simply being declared in advance. The evangelical Republican voters, on the other hand, are not preparing to choose a nominee so much as accommodating themselves to some foregone conclusion of a Trump victory.

The voters and the political professionals agree! It is very unsettling to be part of a contest among different political preferences, in which some will win and some will lose. And so the purpose of the caucuses and primaries is supposed to be the speedy ratification of the trends or results of this earlier contest of money and publicity and opinion polling.

Here’s an evangelical voter explaining his position on Trump to the Times:

“Spirituality is a big issue, but we need somebody who’s strong,” said Charles E. Henderson, 61, a disabled veteran from Lexington, Ky., who grew up attending a Nazarene church.

As one contemporary political thinker put it, in a somewhat different context, “When people see a strong horse and a weak horse, by nature, they will like the strong horse.”

One way to identify which horse is stronger, between horses, is to have the horses run an agreed-upon distance. This is the prospect that’s reportedly unsettling the Clinton campaign. The Times offers reassurances from her campaign manager, Robby Mook, about the campaign’s appetite for racing.

“It’s not just a question of the first two states or the first four states,” Mr. Mook said in an interview at Sunday’s Democratic debate in Charleston, S.C. “We’re going to keep going into the map as long as it takes.”

As long as it takes—not just four percent or eight percent of the 50 states, but even more states than that! It could go “into late April or early May,” the Times reports. At least the citizens of New Jersey, California, and all the other states voting from mid-May on can continue to trust in the system and know that their votes won’t matter.

Ethan Couch's Lawyers Say They Are Investigating Whether the Affluenza Teen Was Forced to Go to Mexico

Ethan Couch’s lawyers say that they are investigating whether the 18-year-old arrested in Mexico last month fled there, willingly violating the terms of his probation, or was forced, Reuters reports. “We are examining the facts...to determine whether he was taken voluntarily or involuntarily to Mexico,” attorney Scott Brown said.

The “affluenza” teen is being held in a Mexico immigration detention center. Last month, he was apprehended, with his mother, Tonya Couch, 48, in the resort town of Puerto Vallarto.

The teenager faces charges of violating his probation in the 2013 drunk driving case that left four people dead; his mother, who has been returned to Texas, is accused of hindering apprehension of a felon, a felony charge that carries a potential 10-year prison sentence.

Tarrant County prosecutors want to try Couch, who was 16 at the time of the incident, as an adult. They contend that he was a willing participant in his flight to Mexico. (That certainly seems to be the case.)

According to CNN, an attorney for Tonya Couch, Stephanie Patten, was not aware of the possibility that her son had been taken out of the country against his will. (That is to say: kidnapped by her.) “I haven’t seen any evidence that that happened,” Patten said.

Tarrant County juvenile court Judge Timothy Menikos recently deferredruling on a motion to transfer Couch’s case to adult court, Reuters reports, because Couch’s parents—who are divorced—had not each been properly informed of the proceedings. The next hearing is set for February 19.

Carson Campaign Worker Killed in Car Accident in Iowa

One of the four Ben Carson campaign workers injured in a car accident in western Iowa on Tuesday has died, the Des Moines Register’s Jennifer Jacobs reported on Twitter. The male volunteer, Braden Joplin, was 25.

According to the Associated Press, Carson cancelled his scheduled events after the Tuesday morning crash: the van carrying three volunteers and a paid staffer hit an icy patch in the road in Cass County, Iowa, flipped onto its side, and was struck by another vehicle.

Carson was in South Carolina on Tuesday, but had made plans to fly to Omaha to meet with the workers in the crash.

Ted Cruz Attack Ad on Donald Trump Can't Keep All These "P.C. Liberals" Straight

The Courageous Conservatives PAC, which supports Ted Cruz, released a new campaign ad on Monday criticizing Donald Trump’s (actually hilarious) endorsement of Bill de Blasio for New York City mayor. When the scary voice-over mentions the mayor siding with “P.C. liberals to let the homeless run wild on city streets,” it shows an image of an elderly black man speaking into a megaphone. However, this photograph is from a demonstration against the de Blasio administration’s homelessness policies—specifically, the aggressive deployment of the NYPD in East Harlem to harry and harass the homeless people who live there.

The protest, organized by activist group Picture the Homeless, took place on September 9, 2015, on 125th Street. Here is the image in question, from the campaign ad:

Police Report: Track Palin Punched Girlfriend in the Face and Threatened Suicide

Track Palin—the 26-year-old son of Sarah Palin, who today endorsed Donald Trump for president—was arrested last night, and court documents obtained by Gawker reveal more details about the bloody and frantic altercation.

According to a police report written by Officer Andrew Kappler—and first reported by the AP and KTVA in Alaska—Wasilla police were dispatched to a home owned by Sarah and Todd Palin after receiving a 911 call from a woman who said that she had been punched in the face by a male who was also in possession of a gun. 911 dispatch also received a call from Track Palin, informing them that the woman who had previously called them was drunk.

Kappler writes that upon arriving at the home he found Palin outside talking on his phone with a “visible injury” to his right eye. He also observed that Palin’s eyes were bloodshot and that his breath smelled like alcohol, and writes that Palin was “uncooperative, belligerent and evasive.” Because of Palin’s “escalating hostility” and the “unknown whereabouts” of the victim, Kappler placed Palin under arrest.

Soon after Palin was handcuffed, other officers on the scene located the victim, who is identified in the report as Palin’s girlfriend. She was found “hiding and crying underneath a bed inside the residence” and told police that earlier in the night Palin had struck her near the eye with a closed fist and then held a rifle to his head threatening suicide (the victim’s last name has been redacted):

She and her boyfriend of one year, Track Palin, left a different residence together and were arguing the whole way home. Once they got to his home they argued in the car, then in the driveway . They were screaming and he was calling her names. [Redacted] told Palin that she had called the cops even though she had not, in attempt to calm him down and to scare him away from “touching her”. Palin approached [Redacted] and struck her on the left side of her head near her eye with a closed fist. [Redacted] got on the ground in a fetal position because she didn’t know what else he would do. Palin then kicked [redacted] on the right knee. [Redacted]’s phone was sitting on the ground in front of her. Palin took her phone and threw it across the driveway. She retrieved the phone and went inside the house. Palin was already inside and holding onto a gun, yelling “do you think I’m a pussy?” and “do you think I won’t do it?” [Redacted] stated Palin “cocked the gun” and was holding the rifle out next to him with the his right hand near the trigger and his left hand near the barrel, with the barrel just away from his face pointed to the side. [Redacted] was concerned that he would shoot himself and ran outside and around the house. She didn’t see where Palin went, so she went inside and up the stairs, where she hid under a bed. Shortly after, she heard Palin walking around inside looking for her. Palin left after not locating her.

Kappler writes that another officer noted injuries to the victim’s face and knee as well as the presence of an unloaded AR-15:

Sergeant Rader observed [redacted] to have bruising and swelling around her left eye. She complained of pain to that area as well as to her right knee. He observed a small red area near her knee. The involved firearm, an unloaded AR-15 rifle was located on the kitchen counter.

According to court records, Palin posted $1,500 bail and is due in court on Feb. 19. The full police report is below. Further documents can be read here.

Following Sarah Palin’s endorsement Tuesday of Donald Trump, GOP consultant Rick Wilson, who is not mad, but trolling, described members of the American “alt right” (which is basically code for white supremacists) as “mostly childless single men who masturbate to anime.”

The point was to discredit them as a category, bereft of any “real” political significance. Which is probably true! And, if it is, may explain, in part, why they are such psychopaths. However, it is also a discredit to those who masturbate to anime.
