Are Chris Christie's Hands Even Smaller than Donald Trump's?

Marco Rubio, trying to be mean again, claimed at a campaign rally on Sunday that Donald Trump has small hands for how tall he is, and that “You know what they say about men with small hands—you can’t trust ‘em!”

Earlier this year, Washington Free Beacon blogger Andrew Stiles mocked Trump’s “shrimp fingers”, but observers have pointed out Trump’s deficient digits for decades. Indeed, Spy Magazine’s “short-fingered vulgarian” is something like the ur-Trump descriptor. Graydon Carter recently reflected on its coinage:

To this day, I receive the occasional envelope from Trump. There is always a photo of him—generally a tear sheet from a magazine. On all of them he has circled his hand in gold Sharpie in a valiant effort to highlight the length of his fingers. I almost feel sorry for the poor fellow because, to me, the fingers still look abnormally stubby. The most recent offering arrived earlier this year, before his decision to go after the Republican presidential nomination. Like the other packages, this one included a circled hand and the words, also written in gold Sharpie: “See, not so short!” I sent the picture back by return mail with a note attached, saying, “Actually, quite short.” Which I can only assume gave him fits.

Chris Rock Invited Stacey Dash Onstage For the Biggest, Weirdest Troll We’ve Ever Seen

In what felt like a collective hallucination, Oscars host Chris Rock brought Stacey Dash onstage Sunday night directly following a sharp monologue slamming Hollywood for its diversity issues.

You know, Stacey Dash—the Fox News commentator who called the wage gap “an excuse” and rape victims “bad girls who like to be naughty,” who protested the existence of Black History Month, and who disagree with her colleagues who called for an Oscars boycott.

“It’s hard to get a job, and that’s the truth out there for black actors,” Rock began. “But let me tell you some good news: the Academy has taken steps to fix this problem, and that is why it is my honor to introduce the director of our minority outreach program. Please welcome Miss Stacey Dash!”

The silence was deafening.

She came onstage with a weird, villainous giggle, and said: “I cannot wait to help my people out. Happy Black History Month!” Then she giggled again, said “Thank you,” and walked offstage.

...What? Why? How? Was Chris Rock trolling this woman hard? Considering it’s the most awkward thing I’ve ever seen in my entire life, seems like something got lost in translation

In a blog post on Patheos.com entitled “Who is Stacey Dash and why did she just walk across the #Oscar stage?”, Dash explained her thoughts on her own inclusion:

When they added ME to increase the diversity, I’m sure many black people rolled their eyes. I’m not “black enough,” they say. But guess what? I’ve heard that all my life. I would rather be a free thinking, black than a cookie cutter black who thinks – and votes – just like all my friends.

Yes, I’m the actress from the South Bronx who has always dreamed of winning an Oscar. But God has a great sense of humor and this is my first encounter with one of my dreams of destiny. Bringing diversity to Hollywood… not merely because of color, but politics as well. (After all, different colors of skin is an easy kind of diversity. Ideological diversity is much harder, because it forces everyone to come face to face with actual beliefs. Hollywood needs BOTH.)

Three Sudanese Immigrants Shot "Execution Style" in Indiana

Last week, two men and a teenager were found dead in Fort Wayne, Indiana, having been shot “execution style,” authorities said. All three were immigrants from the Sudan, according to WANE-TV: Two were Muslim and the third Christian.

Police found the bodies of Mohamedtaha Omar, 23; Adam Kamel Mekki, 20; and Muhannad Adam Tairab, 17, at an abandoned house owned by an absentee landlord in Indianapolis, and known to be a hangout spot for younger immigrants living in the area, the Associated Press reports.

Public Safety Director Rusty York told WANE the victims had been shot multiple times in “execution-style” killings. But he also said that authorities are not yet investigating the shooting as a hate crime: “We don’t believe that’s the case at all.” Police Chief Garry Hamilton said that the three were not known to have been involved in any gang activity. He also speculated that there was likely more than one person involved in the shooting.

“With that many people involved, victims, it’s hard for one person to commit that act by themselves so there had to be some other people present,” the police chief said. “These young people were just starting out their lives, and now, they’ve lost their lives. I need the citizens of Fort Wayne to support us to give us this information and anyone with information about this to help solve this case.”

Omar and Tairab were laid to rest on Saturday. “We all came here to find peace and security,” Abdelaziz Hassab, a relative of both, told WANE. “We’re from the war zones, but the destiny waiting for us is real crazy.”

“People got laid down and shot multiple times on the head,” he said. “So this is no game. It’s serious.” According to the Indianapolis Star, federal law enforcement is assisting with the investigation.


American Student Detained In North Korea Gives Televised Tearful "Confession"

Otto Warmbier, the University of Virginia student who has been imprisoned in North Korea since the beginning of 2016, was presented before assembled press in Pyongyang today to deliver what appeared to be a hopelessly coerced confession, in which he admitted he attempted to steal property from a staff lounge at the hotel where he was staying. After, Warmbier broke down in tears and begged for his release back to the United States.

You can watch footage from the press conference above, via the AP. Warmbier confesses that he “committed my crime of taking out the important political slogan from the staff-only area of the Yanggakdo International Hotel, aimed at harming the work ethic and the motivation of the North Korean people.”

More context comes from CNN, citing a “North Korean official with direct knowledge of Warmbier’s case”:

North Korea accuses Warmbier of surfing the Internet to study different North Korean political slogans and plotting to steal one by folding it up on a thin rectangular metal sheet, and concealing it in his suitcase.

The official says Warmbier put on “quiet shoes” he brought from the United States, and just before 2 a.m. on January 1, 2016, he entered the staff-only second floor of the hotel intending to steal a sign or banner with a political slogan.

“The slogan was bigger than he had thought. So he couldn’t take it away and turned it upside down and deserted (it) on the floor when he had pulled it from the hangers,” the official said.

Even further context comes from the independent website NK News, which notes that visitors to the Yanggakdo Hotel have long had a curiosity with its staff-only areas, specifically on the so-called mysterious fifth floor:

There has long been curiosity about the staff-only area of the Yanggakdo – located on the hotel’s ‘missing’ fifth floor – among foreign tourists.

With no button for the fifth floor on the hotel’s elevator, visiting foreigners have use fire escapes from the fourth and sixth floor to get access to the area, which is often unlocked.

Blogger Calvin Sun previously posted pictures of the political slogans on display in the area, including anti-U.S. and anti-Japanese imperialism. Posters boasting of the country’s information industry and praising “our general” also appear to be included.

“Our policy on going to the fifth floor is ‘do not go there,’” said Troy Collings, DPRK managing director of Young Pioneer Tours, the tourism company which Warmbier travelled with.

Though it seems plausible that Warmbier did actually attempt to take home a souvenir from the Yanggakdo Hotel, his full confession is plainly absurd and farcical. At the press conference, he alluded to attempting to steal the sign in concert with a church in his Ohio hometown, an alleged UVA secret society and the American government.

“My reward for my crime was so much smaller than the rewards that the Z Society and the Friendship United Methodist Church get from the United States Administration,” Warmbier said.

The North Korean official who spoke to CNN said the country believes Warmbier was going to give the stolen item to his church in exchange for a “$10,000 used car,” and per NK News the reward also included $200,000 from the church for “university tuition” for his siblings.

You can watch further clips from the press conference below via RT America. Warmbier is shown marching into the room with his head down while bracketed by two military officers. Later he openly weeps as he asks to be sent back to his family, and before leaving he pointedly bows to the assembled audience.

In a statement released to CNN, Warmbier’s parents said this was the first time they had seen any images of their son since he was imprisoned several months ago:

“We had not heard from him during these many weeks, so you can imagine how deeply worried we were and what a traumatic experience this has been for us,” Fred and Cindy Warmbier said in a statement released Monday. “He seems to be in good health, although we won’t know for sure about his condition until we have a chance to speak with him.”

The New York Times Refuses to Release Recording of Donald Trump’s (Off-the-Record) Comments on Immigration

BuzzFeed’s Ben Smith has an inside baseball report about a January 5 meeting between Republican frontrunner Donald Trump and the editorial board of The New York Times. According to Smith, many Times employees believe Trump conveyed to the paper—during a portion of the meeting deemed off-the-record —that his extreme policy positions on immigration are more flexible than he’s publicly admitted. Still, the Times refuses to release a transcript of the meeting, or even discuss Trump’s off-the-record comments:

I wasn’t able to obtain the recording, or the transcript, and don’t know exactly what Trump said. Neither Baquet, Collins, nor various editorial board members I reached would comment on an off-the-record conversation, which the Times essentially said they cannot release without approval from Trump, given the nature of the the off-the-record agreement. Times editorial page editor Andrew Rosenthal told me he would not comment “on what was off the record at our meeting with him.”

The paper tells Smith that it would release their recording of the meeting, which has “reached near-mythical status at the Times,” only after obtaining Trump’s permission. The candidate’s campaign did not respond to Smith’s request for comment.

(We asked Smith, who serves as editor-in-chief of BuzzFeed, whether his site would release a transcript or recording of an off-the-record conversation it had conducted with a candidate (or anyone else) without obtaining their permission first. His response was: “No.”)

Bill O’Reilly Loses Custody of Children In New York Court Ruling

A New York appeals court held last week that Fox News host Bill O’Reilly’s school-age children don’t want to live with him anymore, and should live exclusively with their mother, O’Reilly’s ex-wife Maureen McPhilmy.

The lengthy decision affirms the holding of a Nassau County Supreme Court justice last year that the children, now aged 13 and 17, should live full-time with their mother (the former couple had been splitting residential custody). As we reported at the time, O’Reilly appealed that ruling, thereby delaying its enforcement (and, of course, extending his multi-front battle against McPhilmy and her new family).

The Appellate Division issued its 1,400-word opinion on February 24, a little over a month after attorneys for O’Reilly and McPhilmy—known in court documents as Anonymous 2011-1 and Anonymous 2011-2—presented oral arguments at the division’s courthouse in Brooklyn Heights. According to the opinion, the court’s four justices unanimously ruled in McPhilmy’s favor based upon “the clearly stated preferences of the children”:

Viewing the totality of the circumstances, there is a sound and substantial basis for the Supreme Court’s determination that it is in the best interests of the children for the mother to be awarded primary residential custody. Particularly relevant in this case are the clearly stated preferences of the children, especially considering their age and maturity, and the quality of the home environment provided by the mother[.]

The preference of McPhilmy and O’Reilly’s 17-year-old daughter is not particularly difficult to guess: As we noted last year, she told a court-appointed forensic examiner that she witnessed O’Reilly drag her mother down a staircase by the neck. (According to court transcripts obtained by Gawker, she also viewed O’Reilly as a temperamental, absentee parent who was uninterested in developing a relationship with her.) At a January 22 hearing, the children’s court-appointed lawyer, Barbara Kopman, told the appellate court that both the daughter and son strongly preferred living with their mother over their father. (Gawker was able to attend but not record the court session, which was open to the public.)

While the court awarded sole residential custody to McPhilmy, it decided that O’Reilly and McPhilmy should continue to share legal custody—meaning that, even though they live with their mother, their father will continue to share joint authority over questions like which schools they attend, any medical care they receive, and what religion they practice; O’Reilly had demanded sole legal custody, an arrangement under which he alone would decide such matters.

Being able to influence his children’s religious observation would likely be a priority for O’Reilly, who is well-connected within the Catholic Church. Those connections may explain why, after their divorce was finalized, the Church reprimanded McPhilmy in writing for telling her children her second marriage was valid in the eyes of God. (O’Reilly has also sought to formally annul his and McPhilmy’s 15-year matrimony, which produced the two children whose lives he now seeks to control.) But both the Nassau County justice overseeing the original case and the Appellate Division rejected his request for sole authority.

The same appeals court ruled in McPhilmy’s favor over two years ago, in January 2013, after she discovered that the purportedly neutral therapist she and O’Reilly had hired to arbitrate custodial disagreements had been hired by O’Reilly to “perform virtually all of his parental duties.” In that opinion, the court remitted, or sent back, McPhilmy’s request for sole custody to the Supreme Court of Nassau County, where she later won it. In the most recent opinion, however, the court simply upheld the lower court’s ruling, thereby preventing this portion of the case from being further drawn out.

O’Reilly’s legal dispute with McPhilmy is not entirely over, though. According to the court docket of the original divorce case in Nassau County, O’Reilly is currently pursuing contempt of court charges against his ex-wife:

This motion indicates that O’Reilly or his lawyers believe McPhilmy has violated or otherwise ignored the court’s instructions. The docket does not say exactly why O’Reilly believes this, since in New York the details of divorce case motions are not public. But a person familiar with the case tells Gawker that the motion most likely arose from O’Reilly’s belief that his ex-wife was interfering with the custody arrangement for their 17-year-old daughter. The same person tells us their daughter has repeatedly refused to visit her father on the days designated for them to be together—a pattern of behavior for which O’Reilly is apparently blaming McPhilmy, rather than his own erratic behavior.

The justice in Nassau County in charge of the original divorce case has not yet ruled on O’Reilly’s latest motion. It’s not clear, either, whether the Fox News host will appeal the Second Department’s ruling to the next highest court, the Court of Appeals in Albany. It’s unlikely he would succeed in doing so, though. To be granted the opportunity to appeal, his lawyers would have to successfully argue that his divorce case raises questions about settled state law.

Furthermore, the Second Department’s opinion seems to discourage O’Reilly from pursuing any further appeals. Its third sentence—“ORDERED that the [lower court’s] order is affirmed, with costs”—indicates that O’Reilly must pay his ex-wife’s attorney fees.

Attorneys for McPhilmy and O’Reilly did not respond to requests for comment.

Donald Trump and Chris Christie were friends before each began running for president, and they’re certainly friends now that Christie is campaigning on Trump’s behalf as his first major establishment endorsement. But in the months between those periods—when Trump appeared to be little more than a nuisance to party favorites like Christie, before eventually overtaking them all—the two sniped at each other with fervor.

Of course, that is what politicians, even friendly ones, do to each other. But that fact doesn’t make Christie’s entirely logical repudiations of Trump any less absurd, now that he is thunderously endorsing him for president, and probably angling for a spot in his cabinet, if not next to him at the top of the ticket.

How Rent-Seeking Is Driving Inequality

When someone like Bernie Sanders rails against a “rigged” economy that is fueling inequality, some believe that he is espousing a radical view. Nothing could be further from the truth. Even the White House knows the economy is rigged.

One newly released and enlightening document you may enjoy reading today is the Annual Report of the Council of Economic Advisers to the President—the report that sums up where the American economy stands this year, from the Obama administration’s top economic advisors. Much of this year’s report is dedicated to America’s vast economic inequality—of income and of wealth—and what is driving it.

Many factors contribute to it, of course. But one thing that this thoroughly mainstream report zeroes in on are “rents” that are being collected by the most powerful companies and people in America. “Rents,” you may know, are the economic term of art for ripoffs, skims, soaks—money that flows into someone’s pocket not because they earned it, but because they are powerful enough to simply demand it. From the report:

But many economists have recently emphasized another contributor to rising income inequality: “economic rents.” Rents are unproductive income paid to labor or capital above what is necessary to keep that labor at work or that capital invested. Rents arise when markets are not perfectly competitive, such as when uncompetitive markets yield monopoly profits or preferential regulation protects entities from competition. For example, a firm might be willing to sell a piece of software for $20 based on costs and a reasonable return to capital. But if the firm has no competition, it may be able to sell the same product for $50—the $30 difference reflects an economic rent. Rents can serve a productive purpose in encouraging innovation. Some rents are inevitable, but the critical question is how they are divided—for example, between profits and wages. And in many cases the evidence suggests that the pursuit of such rents (“rent-seeking behavior”) exacerbates inequality and can actually impair growth.

These rents accrue to companies, and then to top executives and shareholders, ultimately fueling their wealth at the expense of workers.

The rising importance of unproductive economic rents is likely also contributing to the broad increase in inequality. Workers and managers at firms earning supernormal return—likely reflecting increased aggregate rents—are paid progressively more than their counterparts at other firms. Moreover, as union membership declines, inequality can rise further as workers at the bottom of the income distribution lose market power.

How does declining union membership enable the corporate rent-seeking that drives inequality?

Whenever a firm hires a worker, the difference between the highestwage the firm would pay and the lowest wage the worker would accept is thesurplus created by the job match—an economic rent. The division of thatrent between firm and work depends on their relative bargaining power. Asmarkets grow concentrated and certain forms of labor are commoditized,the balance of bargaining power leans toward the firm. Unionization andcollective bargaining—along with policies like the minimum wage—helplevel the playing field, concentrating labor and encouraging the firm to sharethose rents with labor.

Furthermore, income inequality in the short term turns into wealth inequality in the long term, which then fuels more inequality, because wealth not only creates more wealth but also warps our political system to its favor.

As the distribution of wealth becomes increasingly unequal, the returns to that wealth—like interest, dividends, and capital gains—will generate more inequality. In addition, the fact that those at higher wealth levels seem to receive higher returns to capital, when coupled with reductions in tax rates on capital income in recent decades, has increased the contribution of capital income to overall inequality. Further, if some firms earn monopoly profits, owners of those firms may benefit more than others.

One perspective on wealth inequality comes from the Federal Reserve’s Survey of Consumer Finances (SCF) which, as shown in Figure 1-3, shows that the top 3 percent of households have held more than 50 percent of aggregate wealth since 2007 (Bricker et al., 2014). This share has been on a consistent uptrend since the late 1980s. The next 7 percent of households in the wealth distribution hold roughly 25 percent of aggregate wealth, a share that been fairly stable time during this period. Notably, the loss in wealth share experienced by the bottom 90 percent of households, which in 2013 held only 25 percent of all wealth is accounted for by the rise in share captured by the top 3 percent. This is not a uniform spreading of the wealth distribution; it is a rising concentration of wealth at the very top.

The very rich are getting richer, at the expense of the rest of us. This is not a radical viewpoint. It is well understood by everyone. The hard part is not grasping what is happening. The hard part is motivating people to do something about it.

QUIZ: Who Said It—Donald Trump or Benito Mussolini?

Early yesterday morning, Donald Trump decided to retweet a Benito Mussolini quote originally posted by Twitter bot that Gawker had made several months ago, expressly for the purpose of goading Trump into retweeting a Benito Mussolini quote. In sending out that one little tweet, Donald Trump proved the point we had in mind when we created that bot: to show that Trump’s rhetoric is often indistinguishable from that of history’s most vainglorious and authoritarian fascist dictators—Benito Mussolini, specifically.

The bot had a cache of several dozen quotes, each one widely attributed to Benito Mussolini but credited, in this case, to Donald Trump. And apparently, the sound of Mussolini’s words next to his name delighted Trump enough for him to pull it out from among the barrage of countless other tweets making up his notifications. After all—it certainly sounded like something Donald Trump would say.

In fact, a lot of the founding father of fascism’s words sound like Trump-isms, so it’s hard to blame him for being confused. No need to take our word for it. Go ahead and see for yourself.

Ted Cruz and Marco Rubio Want to Hear the New York Times' Off-The-Record Donald Trump Recordings

Now that there’s an alleged recording of comments Donald Trump made about his immigration policy, off-the-record, to the New York Times, perennial runners-up Ted Cruz and Marco Rubio are campaigning on it, and hard.

BuzzFeed first reported the existence of the recording, which apparently captured an off-the-record discussion wherein Trump admitted the extreme views he’s espoused on immigration are actually more flexible than he’s let on.

Cruz, less than two hours after the story first appeared on BuzzFeed, gave a press conference calling on Trump to ask the Times to release the tape.

“Now that’s been reported, the New York Times apparently has this on tape, but it was an off-the-record tape. And so the New York Times has said they will not release the tape unless Donald gives them permission to do so,” Cruz said, before asking that the story wrap up in time to help his own campaign. “I call on Donald, ask the New York Times to release the tape, and do so today before the Super Tuesday primary.”

Rubio too called on Trump to prove he really believes what he says about immigration, a lack of consistency that, if true, nonetheless hasn’t seemed to hurt Trump in the past.

Trump has, so far, not responded.

New York City Is in the Throes of a Häagen-Dazs Heist Epidemic

Is New York a city in decline? DNAinfo reports that last week, an unnamed thief stole $113.80 in Häagen-Dazs ice cream from a Times Square Duane Reade. The news comes after reports of 10 other large-scale Häagen-Dazs thefts over the last four months. Forget about subway slashings—the ice cream thief’s spree is what New Yorkers should really be afraid of.

Shockingly, the New York Post, which ordinarily jumps at the chance to bleat about declining quality of life or draw conclusions about it from meaningless data, has not yet put this very real crime wave on its cover. HÄAGEN-BLAZ, the coverline might read, accompanied by a poorly photoshopped picture of Bill de Blasio eating ice cream with a fork and knife as the city burns around him.

DNAinfo has been following the story impressively closely, reporting that the thieves are most likely flipping their product at bodegas, not consuming it themselves. If you get your sugary dairy fix at the corner store because it’s cheaper than your local Key Food, now you know why.

One ice cream crew was arrested last month earlier this month after allegedly stealing thousands of dollars worth of H-D from stores around Manhattan. Last week’s bust suggest they weren’t the only ones in the game, or else they reunited for one last big score before they’re sent to the big house. (I’d watch that movie.) Either way, keep a watchful eye, New York.

New York Judge Rules US Can't Force Apple to Help Unlock an iPhone 

On the eve of a Congressional hearing about the Department of Justice’s fight with Apple over a locked iPhone, a Brooklyn judge has ruled that the DOJ cannot force Apple to assist in unlocking an iPhone in a separate New York drug case.

Judge James Orenstein rejected the government’s interpretation of the All Writs Act, ruling that it cannot compel Apple to create software that will weaken its security protections using that statute. Orenstein arguing that the government’s expansive interpretation of the All Writs Act would “cast doubt on the AWA’s constitutionality if adopted.”

This is an unambiguous victory for Apple. Orenstein is calling this government overreach in clear terms:

The implications of the government’s position are so far-reaching – both in terms of what it would allow today and what it implies about Congressional intent in 1789 – as to produce impermissibly absurd results.

“Absurd” showed up at least six times, as USA Today journalist Brad Heath pointed out on Twitter.

Orenstein believes that Apple has a better argument about the role of the Communications Assistance for Law Enforcement Act in the case:

Both the government and Apple agree that CALEA does not compel a private company such as Apple to provide the kind of assistance the government seeks here. See Govt. II at 22; Apple II at 5. They disagree as to why that is so: the government contends that CALEA simply has nothing to say on the matter,while Apple argues that the omission reflects a legislative choice. As explained below, Apple’s argument has more merit.

The Department of Justice is still attempting to compel Apple to create software to help it unlock a phone connected to the San Bernardino shooting. Just like with this drug case, the DOJ is using the All Writs Act in an attempt to carry out a search warrant for the phone.

Orenstein’s dismissal of the AWA is bad news for the government, but it certainly doesn’t put the issue between the DOJ and Apple to rest. It’ll be a tool for Apple, but it’s not binding. Since the San Bernardino case involves a more serious crime than a simple drug case, the DOJ could argue that the cases are not similar.

But while this doesn’t guarantee victory for Apple in the San Bernardino case, it may have a major impact on how the All Writs Act gets used, as attorney and Brookings Fellow Susan Hennessey pointed out on Twitter.

“It’s a meticulous and scholarly opinion. It should be a roadmap for any court considering one of these requests from the government,” ACLU attorney Alex Abdo said in a statement.

Report: High-Ranking Duke Official Allegedly Called Parking Attendant "Dumb, Dumb, Stupid Nigger"

Tallman Trask III is an executive vice president at Duke University. In that capacity, he serves as the school’s “principal administrative and fiscal officer.” On Aug, 30, 2014, a school parking attendant says that Trask hit her with his Porsche and then, as he was driving away, called her a “dumb, dumb, stupid nigger.”

The accusation was revealed today by The Chronicle, Duke’s student paper. According to victim Shelvia Underwood, Trask was attempting to access a closed road on the night of a football game against Elon University when he was blocked by Underwood, who is a contract employee of McLaurin Parking and Transportation. Underwood says that before she could explain to Trask why she had stopped him, he hit her with his car, rolling her up onto the hood before she slammed back onto the ground. Via The Chronicle:

After the game had already started, Underwood said Trask approached in his silver Porsche while she was speaking with a pedestrian. Underwood said that in order to help the pedestrian, she stopped Trask. She added that she did not realize who Trask was because she was a contract employee.

As Underwood started to turn around to address Trask, he hit her with his car, she said.

“As I turn back around, I take a step and this car has hit me. My hands are on the hood, then I hit the ground,” Underwood said.

Underwood got off the ground, then said she shouted at Trask, “Really sir, really? You’re in that much of a hurry that you hit me with your car?”

Underwood said she told Trask that the road was closed unless he had a parking pass. Rather than initially showing Underwood a pass, Trask responded by banging on the steering wheel and saying, “This road is not closed” twice, Underwood said. Underwood explained that Trask then held up two parking passes—which she said was “all he needed in the first place” to be allowed to go through.

As Trask drove off, Underwood said he called her a “dumb, dumb stupid n*****.

That Trask struck Underwood with his vehicle is not in question. There were several witnesses—including a co-worker of Underwood’s—who saw it happen. Trask also had an underling deliver a handwritten, signed apology to Underwood at a subsequent football game three weeks later. It read:

Dear Ms. Underwood,

I very much regret the incident before the Elon football game. I should have been more patient and I apologize.

But when asked about the incident by The Chronicle, Trask first denied ever having hit Underwood. It was only “after he was presented with a picture of his written apology note via email” that Trask admitted to his role in the incident.

That initial lie perhaps takes on even greater importance given that Trask maintains that he never said the racial slur. None of the witnesses interviewed by The Chronicle directly overheard Trask saying the n-word, but several did say that Underwood reported the use of the slur in the moments immediately after she was hit. Said one:

After Underwood stopped Trask, the co-worker was still busy with other traffic and could not exactly hear the exchange between the pair, the co-worker explained. The co-worker did see what happened as Trask drove away from the scene.

“She was hopping on one foot back out of the way of the front of the vehicle. And then it took off—there was no, ‘Sorry ma’am,’ or anything like that. As soon as she cleared the front of the vehicle, he was gone,” the co-worker said.

The co-worker also said that after Trask left the scene, Underwood asked, “Did you hear what he called me?” The co-worker added that there were no parking passes visible on Trask’s car.

A parking supervisor employed by the school also told The Chronicle that Underwood immediately made the allegation of racial abuse:

Marian Brown, former lead transit supervisor for PTS and a PTS employee for 23 years, said on the day of the Elon game she was in the command post, where she could hear reports from all employees in the field. She noted that Sam Veraldi, former director of PTS, was also present in the command post when Underwood reported that Trask hit her on the radio.

“I turned up the mic, and said ‘Um, 10-9, could you repeat that message?’ [Underwood] said it again. When she repeated it, I turned the mic up and was watching everyone go, ‘What!’ Everyone started making calls,” Brown said.

Despite medical records showing that Underwood suffered a contusion and possible fractured elbow, she was pressured by her boss—whose company has won the Duke football parking contract for six consecutive seasons—to not file a police report regarding the incident:

Later that day, Wednesday, Sept. 3, 2014, Underwood said she received a call from Steve McLaurin, the owner of McLaurin Parking and Transportation.

“When I see Steve is calling, I know something is up—I’ve worked for McLaurin’s for seven years and had never received a call from him,” Underwood said.

McLaurin told Underwood that because she was not seriously injured and Duke was inquiring about how he was going to handle the situation, “‘a sincere apology [from Trask] should cover it,’” Underwood said. Explaining that she was fearful of losing her job if she filed a lawsuit, Underwood said she told McLaurin that if she received a sincere apology, she would not proceed further.

A report was filed with campus police, but according to The Chronicle it omits Trask’s name as well as any details about the incident, stating only that Underwood came to an officer about “concerned behavior.” A school investigation cleared Trask of the slur accusation.

It’s worth noting that as executive president at Duke, Trask is responsible not just for things like “budget, financial affairs, procurement [and] debt” but also “safety and security, and auxiliary services” including specifically “parking and transportation.” Trask had immediate, if not total, influence over Underwood’s employer’s contract. He also conceivably would have been able to exert influence over Underwood’s employment within the company.

It does not appear as if Underwood’s job was ever jeopardized—and The Chronicle does not say whether she is still employed with McLaurin Parking and Transportation—but the incident had managed to stay under wraps until now. Underwood’s attorney declined to speak to The Chronicle—it appears the paper uncovered the allegations during a larger investigation into Duke’s Parking and Transportation Services Department—but the paper does report that she has “been working to take legal action against Trask.”

Four Students Hurt in Ohio School Shooting

Four students have been injured in a shooting at Madison Junior/Senior High School in Middletown, Ohio, on Monday, after a 14-year-old allegedly opened fired in the lunchroom. None of the injuries are life-threatening.

According to the Associated Press, Butler County Sheriff Richard Jones said that the suspect, who was apprehended with the the help of a police dog, was a student. Jones also said that there was a motive to the shooting, but he did not identify that motive.

The suspect opened fire around 11:30 am on Monday morning. Then, ABC News reports, he ran outside, dropped his gun, and was apprehended while still on school grounds.

Madison is a small school, with about 250 junior high and 500 high school students. From the AP:

Afterward, classmates described a chaotic scene where they weren’t sure what was happening at first.

Thirteen-year-old Shelby Kinnin said she heard “a couple of bangs” and realized she was near the shooter.

“I didn’t really know it was gunshots until I looked over and a kid was grabbing his leg and falling over,” she said.

Many people ran from the scene, and the shooter went out a door, she said. She recognized him as a boy who was in a class with her last year, though she wasn’t sure of his name.

The suspect, who ABC reports has been interviewed by investigators and is being held in a juvenile detention facility, was charged as a juvenile with two counts of attempted murder, two counts of felonious assault, one count of inducing panic, and one count of making terrorist threats. Jones said authorities have not yet determined how he acquired a gun.

New York Nail Salons Ordered to Pay $1.1 Million in Back Wages to Underpaid Employees 

Last year’s bombshell New York Times investigation on labor conditions in nail salons won both praise and criticism, the latter mostly from salon owners, who claimed the story greatly exaggerated how poorly paid many workers are. The evidence continues to show the Times series did indeed find serious flaws in the industry, including widespread underpayment of workers.

On Monday, the Times reported that according to state records, labor investigators cited more than 40 percent of salons they inspected for underpayment. Salon owners were directed to pay out a total of $1.1 million in back wages and “several hundred thousand dollars” in damages to salon employees. Some of the underpayment was severe, the paper found:

Some of the violations were egregious: One worker at a Manhattan salon was paid $30 a day for 10-hour shifts; another manicurist in Queens was paid only $200 for a 50-hour workweek; manicurists at seven salons were forced to work for no pay or had to pay salon owners a fee, ostensibly to learn the trade; several owners admitted to submitting fake payroll records in an effort to fool investigators.

At the same time, the story also found that some of the salon owners cited were people who were unfamiliar with state and city labor laws, many recent immigrants themselves:

Many owners, even some of those making efforts to pay decent wages, simply failed to grasp the technical details of state labor laws. Many salon owners, for example, seemed unaware that they must pay one full hour of bonus wages when an employee’s shift spans more than 10 hours.

Nail workers routinely work days that stretch longer than eight hours and are paid in flat daily or weekly wages, a combination that does not square with state labor laws on overtime pay and essentially guarantees a violation, even when employees are paid a rate that works out to more than the state minimum wage.

Other salon owners have said they have undocumented employees who prefer to be paid in cash, which is undoubtedly also true.

But investigators also found evidence of other illegal practices cited in the NYT series, like charging employees for supplies—gloves, nail polish—or forcing them to pay their bosses for work they performed during an “apprenticeship” period. And one woman working at New Broadway Nails was fired in retaliation for talking to state investigators, which is also very, very illegal. (New Broadway was fined $10,000 for the retaliation, according to the NYT and $5,000 for other violation, in addition to being ordered to pay $84,000 in back wages and $66,000 in damages. The salon is appealing the decision.)

Both the New York Review of Books and the libertarian magazine Reason published stories claiming the Times series was exaggerated or inaccurate; neither has mentioned the new investigation.

Lifehacker held a Hive Five vote several years ago, but since then, battery packs have gotten smarter, faster, and cheaper, so it’s time for a refresher course. Which battery pack do you trust to keep your phone powered on?

Pro-Life Congressman Who Pressured Mistress into Getting Abortion Endorses Trump

Notoriously hypocritical anti-abortion Congressman Scott DesJarlais, Republican from Tennessee (which is a Super Tuesday state), has endorsed Donald Trump, the Guardian reports. DesJarlais’s ex-wife and his mistress have undergone abortions either at his behest or as the result of a “mutual decision.”

According to his own website, the congressman “believes that all life should be cherished and protected.” Last year, DesJarlais voted in favor of a federal 20-week abortion ban. And in a statement Monday, DesJarlais said,

While there are certainly things that I admire and respect in each of the remaining candidates, I believe Donald Trump is the candidate best poised to make America great again. As such, I was proud to cast my vote for Mr. Trump.

Before he was a politician, DesJarlais was a doctor, and he met the woman who would become his mistress when she was a patient. In 2012, the Huffington Post obtained transcripts of a 2000 phone call between the two in which DesJarlais entreats her to get an abortion. “You told me you’d have an abortion, and now we’re getting too far along without one,” DesJarlais says. “You told me you would have time to go with me and everything,” the woman replies.

“I said, if I could, I would, didn’t I? And I will try,” he says, “If I can [find] time, you’re saying you still will?” She acquiesces.

Later, transcripts of DesJarlais’ testimony during divorce proceedings were also released, revealing that he and his wife had mutually agreed that she would get an abortion on two separate occasions. DesJarlais called the decision “a very difficult and poor choice.”

Of course, Trump is an abortion hypocrite as well: Earlier this month, he wrote on Facebook, “I am pro-life.” In 1999, he declared himself “very pro-choice.”

Asked in an early debate to explain the discrepancy, he said, “I hate the concept of abortion. And then since then, I’ve very much evolved. And what happened is friends of mine years ago were going to have a child, and it was going to be aborted. And it wasn’t aborted. And that child today is a total superstar, a great, great child. And I saw that. And I saw other instances. And I am very, very proud to say that I am pro-life.”
