Tennessee Republican Clearly Up to No Good

Here are some recent allegations lodged against Tennessee State Rep. Jeremy Durham (R):

  • According to The Tennessean, Durham sent harassing and/or generally inappropriate text messages to at least three women working at Tennessee’s State Capitol in Nashville. To one woman in particular, the newspaper reported, “Durham repeatedly sent text messages and Facebook messages, sometimes late into the night. One text message, after 10 p.m., says he misses her. In another text, at about 1:30 a.m., Durham asks her for pictures.”
  • According to Tennessee Lieutenant Governor Ron Ramsey, a fellow Republican, Durham had an extramarital affair with another state representative. At a press conference on Thursday, Ramsey told reporters: “The press didn’t force somebody to have an affair with another state Rep. and force them to resign.”
  • According to police in Williamson County, Tennessee, Durham attempted to a fill an illegitimate prescription for Adderall in June 2013 (a revelation that was not reported until December 2015 by the The Tennesseean). However a local jury decided not to issue an indictment against Durham.

Though Durham resigned from his position as House Majority Whip on Sunday, he still appears to insist upon his innocence. Here are his denials of the above allegations, in the same order:

  • Text messages: “Not having seen the texts, not knowing who the other party to the conversation is, when they were sent, what exactly they say, whether I was responding or initiating the text stream, it is simply impossible to respond.”
  • Extramarital affair(s): “As of January 27, 2016, Representative Durham has taken a couple of weeks of leave from the legislature ... Nevertheless, he categorically denies having any physical relationship with former representatives (Mike) Harrison or (Leigh) Wilburn [both of whom recently resigned from the state legislature].”
  • Fraudulent Adderall prescription: “This situation is from two and a half years ago and was fully vetted by 12 Williamson County citizens who quickly agreed that nothing illegal occurred.”

In Confidential Letter, Ousted Mizzou President Blames Black Lives Matter, Football Team For Resignation

Ten days ago, Tim Wolfe—the ex-University of Missouri System president who famously stepped down from his position last November after a black student’s hunger strike made the state’s flagship campus in Columbia the focus of a national discussion regarding the treatment of minority college students—sent an email to confidants that he labeled “CONFIDENTIAL.”

In the message, which was first reported by local papers in Missouri and stretches five pages, Wolfe presents a bullet point list of people who he believes made it impossible for him to keep his job, a group that includes: his boss, ex-Chancellor R. Bowen Loftin; ex-Mizzou football coach Gary Pinkel and his players who joined in the strike; and, most curiously, the presence of an unnamed “significant Ferguson protestor,” a likely reference to DeRay McKesson.

Wolfe places the blame for some of what led up to Jonathan Butler’s protest—temporarily eliminating health insurance for graduate students, the barring of Planned Parenthood from a local hospital—on Loftin, an analysis that at the very least contains partial truth. But despite stating later in the email that he’s “willing to accept some of the responsibility” for his ouster, Wolfe fails to acknowledge the depth of his own culpability: specifically his refusing to seriously consider the demands of Bulter and his organization Concerned Student 1950 until it had become abundantly clear that Wolfe had no way out of the situation.

Wolfe is certainly correct when he states that the “football team’s strike is actually what brought most of the national attention to our university,” though he apparently still thinks that the resultant tidal wave of national attention could have been avoided. “Coach Pinkel missed an important opportunity to teach his players a valuable life lesson,” Wolfe writes, by which we can assume he means that Pinkel should have disciplined his players for exercising free speech.

The funny thing, though, is that it was Wolfe that learned a lesson: football players are more important to colleges than presidents. Or, Wolfe should have learned that lesson—this letter makes it clear that he hasn’t yet. Pinkel, who quickly sided with his players lest he be sacrificed as well, recognized that lesson immediately.

As for Black Lives Matter, Wolfe writes:

My sudden decision to resign was largely motivated by a significant pending event that was to occur on the campus the day I resigned. We had brought in Diversity and Inclusion consulting experts that had dealt with this issue before at other campuses. They, along with the FBI, Missouri Highway Patrol, Columbia Police Department and MU Campus police were aware of a significant Ferguson protestor on our MU campus and there was a threat that more were coming in for significant protest that day. So as to prevent, injury and further embarrassment on our campus, the only way to relieve the pressure and stop the momentum was for me to resign. This was the right decision that was vetted with trusted advisors and board members.

The “significant Ferguson protestor” figures to be DeRay McKesson, who was on campus the day Wolfe resigned, but the entire passage again shows that Wolfe didn’t really learn much from his own resignation. McKesson and further reinforcements from Black Lives Matter weren’t a “threat” to the MU campus, and the only people they were embarrassing were those stubbornly trying to keep the status quo from crumbling.

Remember how Hillary Clinton used a private homebrew email server to conduct official State Department business? Today—only hours before the agency is expected to release the next batch of Clinton’s emails, and just days before the Iowa caucuses—the sitting administration disclosed that 22 of those emails are now considered top secret, and thus exempt from release:

The Obama administration confirmed for the first time Friday that Hillary Clinton’s unsecured home server contained closely guarded government secrets, censoring 22 emails with material requiring one of the highest levels of classification.

As the Associated Press notes, this could very well contradict the argument (floated by Clinton and her surrogates) that the former Secretary of State “never sent or received information on her personal email account that was classified at the time.” Given the nature of the classification, the Obama administration is not required to explain what exactly the top secret emails were about.

The candidate, for her part, appears to be protesting the classification, which allows the government to withhold the entirety of the emails (as opposed to simply redacting certain portions of them). A spokesperson for Clinton’s campaign told NBC News that “we firmly oppose the complete blocking of the release of these emails. Since first providing her emails to the State Department more than one year ago, Hillary Clinton has urged that they be made available to the public. We feel no differently today.”

Steven Avery's Defense Attorney and Prosecutor Address Important Information Making A Murderer Left Out

Since Making a Murderer debuted late last year on Netflix, the internet has been overrun with amateur sleuths looking for evidence presented in Avery’s trial that the show suspiciously overlooked. Investigation Discovery’s Steven Avery: Innocent or Guilty, which premieres tomorrow at 9 pm, features a clip of Murderer co-director Laura Ricciardi explaining, “It would have been impossible for us to include all of the evidence that the state submitted. We chose all of what the state itself was claiming to be its most compelling evidence. We feel that we did a very thorough, a very accurate, and fair job.”

The Keith Morrison-hosted special nonetheless examines several points absent from the series, with commentary from prosecutor Ken Kranz (Former DA, Calumet County, who wanted Avery to confess so that he could write a book about it) and Avery’s former defense attorney Jerry Buting. Among them:

The vial of blood

Kratz calls its handling “one of the more irresponsible claims” of Murderer. “The suggestion is that this purple-topped tube was tampered with, that clearly it had a hole in the top of the tube,” he explains. However, Kratz claims all blood-sample vials carry such holes after the sample has been collected. “How do you think the blood got in there? The blood gets in there by putting a hole in it. There was a nurse that was interviewed that said, ‘I’m the one that put the hole in there.’”

Buting, though, according to Morrison “was more interested in another clue”: the blood that was visible between the stopper and the glass, which, according to Buting “you could only get if the stopper’s taken out,” thus suggesting it had been tampered with and used to plant Avery’s blood in Teresa Halbach’s car.

Kratz points out that Avery specifically called Autro Trader, requested Halbach come to his home, and that he left his sister’s contact information instead of his own.

Buting says the answer for this is quite simple: She was the only photographer for Auto Trader in that whole area of the state. “He doesn’t say, ‘Send Teresa Halbach.’ He says, ‘Send that woman out here again to take pictures. We want to put another vehicle in your magazine,’” says Buting.

Kratz claims, “The filmmakers don’t tell the viewer that Teresa is lured onto the property using the *67 feature, or that different names or phone numbers are used.” On the day of her murder, Avery called Halbach’s cell phone twice using *67 to block his number. He called her again at 4:35 without blocking his number, the implication being that Avery was attempting to give himself an alibi. “Teresa would have been dead by then,” offers Morrison.

Without addressing the *67 flip-flop (per Investigation Discovery’s edit), Buting tackles the state’s theory that Avery attempted to obscure his identity by saying, “The problem with this theory was, if he already had her cell phone, then all he had to do was call her cell phone and have her come out there, but instead he called the Auto Trader office and made an appointment.”

“The vehicle that she was to take pictures of was his sister’s vehicle and she was the one who would ultimately be the seller of the transfer of the title,” says Buting regarding the charge that Avery used a “false name.” On the show, Buting follows this up with, “Kratz has really misrepresented what that evidence was about.”

Additionally, Kratz touches on Halbach’s previous dealings with Avery before her murder: “She told [colleague] Tom Pearce ‘This guy creeps me out,’ and he said, ‘Don’t ever go in that house.’” Morrison claims that “according to a friend of Teresa’s,” Avery at one point answered the door in nothing but a towel when Halbach arrived.

“There’s no suggestion that the officers had vials of Mr. Avery’s sweat with them,” says Kratz regarding the DNA evidence from the skin/sweat of Avery’s fingers that was found on the outside hood latch of Halbach’s car.

“There were no fingerprints at all of Steven Avery on the car,” says Buting. “If he’s wearing gloves, he’s not going to get his DNA on it.”

Additionally, there was the matter of Halbach’s charred cell phone and camera being found in Avery’s burn barrel, evidence of which the series omitted.

In the special, Buting says Kratz “tainted the trial” with his “outrageously inappropriate press conference” that happened the year before, in which Kratz announced that Avery had tortured and raped Halbach. Though these charges did not make it into the trial, one of the jurors nonetheless claimed he or she not only thought Avery was guilty of murder but that he was guilty of rape and torture as well.

Regarding the sexting scandal that happened a few years after the trial and cost Kratz his job, Kratz told Investigation Discovery, “To suggest that those behaviors not only were present three years earlier or five years earlier when the whole case started, but to say somehow it impacted decisions I made or the prosecution or investigation decisions I made is absolutely unfair.”

Who’s Going to Keep Paying For This Crap?

Jim VandeHei, co-founder of The Politico, will leave the Washington-based news operation after the 2016 election. He will take with him Mike Allen, The Politico’s reporter-mascot, who says today that the two plan to start “a new venture that will change the world one more time.”

It seems safe to infer that VandeHei sought more expansion, and was rebuffed. As Erik Wemple says: “The reported departures follow whispers among Washington media circles that VandeHei was clashing with Politico ownership — chiefly Robert Allbritton — about matters related to Politico’s expansion and profitability.”

Meanwhile, at Bloomberg Media, Michael Bloomberg, having returned to running the company full-time after a hiatus spent as New York City’s mayor, appears to be done, more or less, with politics—the domain, at Bloomberg, of superstar reporters Mark Halperin and John Heilemann. Last fall, New York’s Gabriel Sherman reported that Michael Bloomberg, reassessing business decisions made in his absence, was narrowing the focus of his company’s journalism. As part of that narrowing, he doesn’t plan, Sherman claims, to renew Halperin and Heilemann’s contracts after 2016.

Bloomberg has long believed that the news division is supposed to serve the pricey terminals that made Bloomberg rich, and most political reporting—including the sort of personality-focused, policy-agnostic coverage that Halperin and Heilemann specialize in—means little to the firms that pay fortunes for those terminals. The writing has been on the wall for months: Everyone involved in recruiting Halperin and Heilemann and building a “Bloomberg Politics” brand around them—a plan made just before Bloomberg’s return as CEO—is now long gone from Bloomberg Media.

After November, then, Jim VandeHei, Mike Allen, Mark Halperin, and John Heilemann—arguably the biggest superstars of modern political reporting—could all be without platforms. And it’s not at all clear who’d give any of them the cash they’d need to continue doing their current work.

None of them will lack for jobs, if they want them—writing books, giving speeches, consulting, appearing on cable news—but who’s going to give them tens of millions of dollars to invest in starting or running political journalism shops that reflect their particular sensibilities and styles of political coverage?

Maybe Halperin and Heilemann will simply return to book-writing (and book-optioning)—or maybe NBC News chairman Andy Lack, who has frankly baffling beliefs about what large numbers of people might want to watch on television, will just give them a show, to replace the one they host for Bloomberg—a show that MSNBC currently airs, despite it being produced by a rival channel, in one of the strangest arrangements in cable news.

It appears that VandeHei, at least, intends to try to start something new. His statements, and Allen’s, show every indication that the two intend to go off and do to The Politico what VandeHei and John Harris did to the Washington Post..

The founding story of The Politico is that two ambitious Washington Post journalists came up with a plan to shake up the political journalism industry, and found a wealthy backer—Robert Allbritton, a second-generation media mogul—willing to give them the investment necessary to build a powerhouse news outlet from scratch.

That investment was large, and it didn’t pay off right away. The Politico launched in early 2007. It wasn’t until 2009 that it became modestly profitable, earning $19 million on expenses of $17.2 million. Since then, they have expanded considerably—and stopped publicly reporting their operating expenses and earnings, though much of that expansion has happened in the supposedly lucrative paywall journalism business.

Now, to repeat that success story, Heilemann and Allen surely need a mogul or a conglomerate willing to spend big on political journalism, while absorbing a few years worth of probably pretty huge losses. We’re running out of those!

Bloomberg is exiting politics. Chris Hughes is done with The New Republic. Atlantic Media gutted National Journal. Disney killed Grantland—which wasn’t political, but was still Big Name-driven prestige journalism—and divested itself of Fusion. (FiveThirtyEight might find itself in post-election trouble too, though there’s plenty of ways data-driven sports coverage could still be useful to a media organization with a mutually beneficial relationship with scammy daily fantasy sports companies.) About the only people still investing significantly in name-driven politics coverage are Viacom, through some recent MTV hires, and Univision, now the sole owner of Fusion. Neither seems a likely home for Mike Allen and Jim VandeHei.

Whatever happens, an outcome in which Allen, VandeHei, Halperin, and Heilemann have less direct influence over political journalism is one in which political journalism does not greatly suffer, but—speaking as someone who’d like to continue to produce political journalism of my own!—I’m not exactly thrilled about the conditions leading to that diminished influence.

And I may be overly pessimistic. There will always be would-be media moguls. It may also be true that there will always be rich suckers who can be taken in by entrepreneurial journalists with snake oil business plans.

Flint Mayor: Water Still Showing Lead Levels Beyond What Filters Can Remove

After lead poisoned the drinking water in Flint, residents received filters they were told would make their tap water safe. Now, tests over the last 24 hours are showing that lead levels in some homes are still too high for a filter to handle.

At a press conference this evening, Mayor Karen Weaver delivered the statement alongside representatives from the Michigan Department of Environmental Quality, which administered the testing. She encouraged residents to have their water tested immediately before using filters.

Some filters, specifically gravity-fed ones certified by the National Sanitation Foundation, are able to remove reasonable amounts of lead from drinking water, up to about 150 parts per billion. What Flint is seeing, however, are some levels higher than 150 parts per billion—in other words, what can safely be removed by those filters. Some tests showed levels as high as 4000 parts per billion. It’s not every home, but it is enough homes to cause an alarm.

This means that the “reliable” water source from Lake Huron is now not safe anymore due to the way the Flint River water heavily corroded the city’s pipes. Test kits are now being distributed so residents can continue to monitor their water and know when it’s safe to go back to the tap—if it ever will be. The New York Times published a devastating story on how doctors are working to evaluate the damage done to children under age five.

Meanwhile, Congress has proposed $400 million in federal aid which could help replace the city’s lead pipes.

Model Responds to Unwelcome Dick Pics By Contacting Senders' Girlfriends

Emily Sears—a banging model with an hourglass bod and a large Instagram following—is no stranger to unwanted dick pics. Luckily, she’s come up with an extremely rewarding way to deal with them—by sending screengrabs to the senders’ wives, girlfriends, sisters, and moms.

When she’s feeling generous, Sears will merely respond to the dicks who send dick pics with screen captures from Facebook and Twitter that prove that she could easily contact their loved ones if she felt the inclination.

“We send the photos as a reminder for them to have respect for women,” Sears tells Buzzfeed News. “I think it provides an accountability that people seem to lose online; being behind a screen gives people a false sense of anonymity.”

Other times, she’ll go as far as to reach out the senders’ wives and girlfriends. It’s a practice she shares with her friend, L.A. DJ Laura Luxx:

“I think the first time I decided to contact a girlfriend was probably close to two years ago when I opened my Instagram inbox to yet another dick pic with an explicit caption about wanting to fuck me from some random guy I’d never spoken to,” Laura told BuzzFeed News.“I wrote back, telling him that his behavior was terrible, and he replied with a string of sexual slurs and abuse, and kept calling me a slut.”

When Laura clicked on the profile of the man to block him, she noticed almost every photo he had posted was with his girlfriend, and was described in captions by his girlfriend as “the best boyfriend ever!”

“I guess I felt really sad for her,” Laura said. “So I sent her a message with a screenshot of our conversation telling her that I was really sorry, but I thought she deserved to know how her boyfriend was behaving towards other women. “I know if the roles were reversed and it was my boyfriend sending that shit out, I would want to know.”

Sears, who estimates she receives about 1-2 dick pics a day, tells Buzzfeed that the number of photos have started to taper after she started publicizing her outing practices. Until she stops getting inappropriate photos entirely, she’s happy to do what she can to raise awareness of this dickerrific brand of online harassment.

“This isn’t just happening to models with a big followings,” she says. “It’s happening when women are online dating and denying matches with men. It can happen to any woman online, just like it can happen to any woman walking down the street.”

Facebook Bans Gun Sales, Sort Of

Facebook, once a safe haven for gun profiteers and those who wanted to, for some undisclosed reason, anonymously obtain a semi-automatic weapon that can take a life with the push of a button, is clamping down. The social media site announced this week that it will no longer allow private gun sales on its site or on that of Instagram, which it owns.

The ban is largely enacted by other users, according to Facebook. From The New York Times:

Facebook said it would rely on its vast network of users to report any violations of the new rules, and would remove any post that violated the policy. Beyond that, the company said it could ban users or severely limit the ways they post on Facebook, depending on the type and severity of past violations. If the company believed someone’s life was in danger, Facebook would work with law enforcement on the situation.

The news comes after reports of rampant unregulated sales of guns through the social media site, with no accountability for sellers to run adequate background checks on their buyers. In a statement to The New York Times, Monika Bickert, Facebook’s head of product policy, said that the site is “continuing to develop, test and launch new products to make this experience even better for people and are updating our regulated goods policies to reflect this evolution.”

The new ban, however, does not apply to licensed gun sellers, who are still free to peddle their wares unbridled, though they must complete gun transactions off-site (it’s not clear yet how Facebook will ensure this happens). So you can still get a gun on Facebook, you just can’t do it as easily now.

There’s Only One Nurse for 5,500 Students in Flint, Michigan

In a town where lead poisoning is so prevalent that testings are held under the guise of family fun nights, there’s just one nurse on the school district’s payroll.

Her name is Eileen Tomasi, according to Marketplace, and she’s the sole care giver for all 5,500 children enrolled in Flint public schools. The district currently has a deficit of $10 million (which is lower than the previous year where it loomed at $21 million), but the lead crisis, which often demonstrates itself through learning disabilities, means more resources are needed.

“Some of the psychologists in the district have said the little kids, the three, four and five-year-olds that they’re testing, that they’ve already seen a difference. They’re not where they should be right now as far as like sociability skills that they test the little ones. This is going to be an ongoing issue for years and years and years. It’s a whole generation here that’s been poisoned. So the impact on the schools will be huge,” said Tomasi.

District superintendent Bilal Tawwab says his team needs more nurses, special education teachers and early childhood programs to deal with what the water crisis has created. Perhaps some of the $28 million in emergency aid that Michigan Governor Rick Snyder approved on Friday can help Flint’s ailing school district.

Elsewhere, Senate Democrats proposed a federal aid package of $400 million, contingent on Michigan spending the same amount, according to the Daily News.

An assessment cited in the state’s request for a federal disaster declaration estimated the potential cost of fixing the damage to Flint’s water distribution infrastructure at $713 million. It is not, as a rule, charitable to poke fun at another person’s physical shortcomings. However, when that person is both a public figure and a politician who actively and continually draws on the tenets of racism, misogyny and homophobia as a campaign platform, certain concessions can be made.

Republican presidential candidate Donald Trump, it therefore must be said, has shrimp fingers. This is not a new revelation by any means. Earlier this week, Washington Free Beacon blogger Andrew Stiles rocketed the term into the news cycle with a simple, straightforward tweet.

As Buzzfeed quickly pointed out, others piled on the bandwagon, including U.S. Senator from Nebraska, Ben Sasse, who was personally targeted by Trump in a series of tweets.

Trump was once called a “short-fingered vulgarian” by the brilliant minds of the now-deceased Spy Magazine, and for good reason. New York Times Endorses Hillary Clinton for the Democratic Presidential Nomination

On Saturday, The New York Times’ editorial board endorsed Democratic presidential hopeful Hillary Clinton for her party’s nomination, calling her “one of the most broadly and deeply qualified presidential candidates in modern history.” The board wrote:

Hillary Clinton is the right choice for the Democrats to present a vision for America that is radically different from the one that leading Republican candidates offer — a vision in which middle-class Americans have a real shot at prosperity, women’s rights are enhanced, undocumented immigrants are given a chance at legitimacy, international alliances are nurtured and the country is kept safe.

In recent history, the Times has generally endorsed Democrats, going with Bill Clinton in ‘92 and ‘96, Al Gore in ‘00, John Kerry in ‘04, and President Barack Obama in ‘08 and ‘12.

Update 12:09 p.m. As what really looks like an afterthought, the board also published an editorial on Saturday seeming to endorse Gov. John Kasich of Ohio for the Republican presidential nomination, though acknowledging that Kaisch is a “distinct underdog.” It went on:

Still, as a veteran of partisan fights and bipartisan deals during nearly two decades in the House, he has been capable of compromise and believes in the ability of government to improve lives. He favors a path to citizenship for undocumented immigrants, and he speaks of government’s duty to protect the poor, the mentally ill and others “in the shadows.”

Dick Cheney's Unpopular Daughter To Run for Office in a State Where She's Despised

Liz Cheney, an aspiring politician who is unpopular among family members and constituents alike, is taking another crack at this whole power game.

On Saturday, The New York Times reported that Cheney filed federal election documents that indicated she intends to run for a seat in the U.S. House of Representatives. She plans to run in Wyoming, a state in which she has lived only two years—specifically, she lives in Jackson Hole, a resort town located in one of the wealthiest counties in the country. Cheney reportedly will announce her campaign on Monday, running on a pro-coal and anti-climate action platform.

The daughter of accused war criminal Dick Cheney, Liz Cheney is not a newcomer to political races. In 2014, she bailed on a Senate challenge to another Republican, citing “health issues”—not to mention dismal polling numbers.

Cheney has also been publicly denounced by her sister Mary Cheney, a lesbian who said she didn’t support her sister’s campaign last time around on the basis that Liz Cheney actively opposed gay marriage. Mary Cheney has not yet commented on her sister’s latest bid to become a member of Congress who opposes her family’s fundamental human rights.
